The Law Offices of Benjamin Nadig Discusses Comparative Negligence for Auto Accident Claims in Nevada

ReleaseWire

Bristol, PA -- (SBWIRE) -- 10/29/2019 -- If somebody suffers a car accident in the state of Nevada, they can still receive compensation even if the accident was partially their fault. As a motor vehicle accident and felony lawyer in Las Vegas, The Law Offices of Benjamin Nadig has recently explained the tort law rule of comparative negligence and what this means for people who are seeking compensation for injuries and other financial damages incurred after a car accident.

In Nevada, comparative negligence laws give the automatic legal right for a plaintiff in a personal injury case to receive a percentage of the other plaintiff's damages. This only applies if one or more of the defendants have been proven to be at least 50 percent responsible for any accident or injury.

However, the state of Nevada has a 50 percent cap on its system of comparative negligence. This means that as long as the degree of fault is no higher than 49 percent for a plaintiff, they are legally compensable for their injuries. In a car wreck investigation where a plaintiff is proven to be over 50 percent responsible for an accident, they are barred from receiving compensation from the defendant.

In cases where a plaintiff is proven to be less than 50 percent responsible, they face a reduction in damages compared to the plaintiff's degree of fault. In layman's terms, when a plaintiff is found to be ten percent guilty, the number of damages they are eligible to recover will be reduced by ten percent.

The benefit of working with an experienced legal team is that they can gather sufficient evidence to prove all the damages that were sustained. This relates to both economic and non-economic harm. Professional lawyers will negotiate on the plaintiff's behalf against any insurance companies involved, presenting medical, physical, and data-driven evidence to improve the chances of receiving full compensation.
