AMENDED NOTICE OF FORECLOSURE SALE 22 SP 8 Under and by virtue of the power of sale contained in a certain Deed of Trust made by Jeffery B. Cabe (PRESENT RECORD OWNER (S): Jeffery B. Beginning on an iron rod set in a hollow near the center of a road at a corner common to Sawyer (DB. 89 PG. 1) said iron rod set being a tie and bearing S. 22-56-38 W. 755.57 feet from a U.S.F.S. aluminum monument found, and running thence from said beginning point, with a line common to Sawyer (DB. 89 PG. 1), S. 33-47-30 E. 59.53 feet, to an iron rod set in the center of a hollow on the 1710 foot contour line of Fontana Lake; thence, with the 1710 foot contour line of Fontana Lake the following four (4) courses and distances:S.07-25-14 W. 106.29 feet, to a point; S. 00-04-43 E. 59.70 feet, to a point; S. 54-53-23 W. 65.96 feet to a point; S. 80-39-35 W. 65.80 feet, to an iron rod previously set on the 1710 foot contour lint of Fontana Lake at a corner common to Colvard; thence, with a line common to Colvard, N. 18-21-07 W. 877.57 feet, to an iron rod previously set (flush) in the center of a 10 foot wide road at a corner common to at a corner common to Sawyer (DB. 89 PG. 1); thence, with a line common to Sawyer (DB. 89 PG. 1), and with the center of said 10 foot wide road, the following six (6) courses and distances: N. 79-09-31 E. 34.88 feet to a point; N. 62-59-33 E. 40.37 feet, to a point; N. 42-41-00 E. 16.38 feet, to a point; N. 19-32-57 E. 23.14 feet, to a point; N. 12-28-10 E. 82.69 feet, to a point; N. 26-18-05 E. 45.29 feet, to the place and point of beginning, containing 0.45 acres, more or less, by double meridian distance. No. L-3514, entitled, "Boundary Survey for Jeff Cabe", completed February 9, 1998 reference to which is hereby made, which property is more particularly described as follows: Beginning at a new iron pin set at the Southeastern tip or corner of the premises herein, corner common to Colvard (150/161) and to Cabe (158/944), said pin being located N. 18-21-07 W. 50.55 feet from an existing iron pin and running from said new iron pin N. 70-29-49 W. 39.63 feet to a new iron pin; thence S. 73-09-31 W. 25.85 feet to a new iron pin; thence N. 19-33-41 E. 20.80 feet to an iron pin set in the centerline of a 10 feet wide gravel road; thence N. 77-15-40 E. 44.57 feet to a nail set; thence S. 18-21-07 E. 37.05 feet to a new iron pin and place of the beginning, containing 0.026 acres, more or less. Also conveyed herewith is a permanent easement and perpetual right of way which shall be appurtenant to and which shall run with the premises herein; said right and easement shall be ten (10) feet wide and shall be located over and upon the existing 10 feet wide private roadway and easement presently serving for ingress, egress and regress to and from the above-described premises and S.R. #1236 The premises herein is subject to that portion of the 10 feet wide private easement and roadway presently traversing and crossing over and upon the Northwestern corner of the subject property.
