California Personal Injury Lawyer Jeffrey Nadrich Opposes The Protecting Access To Care Act Of 2017

Jeffrey Nadrich, a personal injury lawyer in Palm Springs, California, is a longtime advocate for consumer and patient rights. Mr. Nadrich has been a vocal opponent of the Protecting Access To Care Act of 2017. The U.S. House of Representatives recently passed the bill by a narrow margin, 210-218. The bill is now before the Senate Judiciary Committee for review.

The Protecting Access To Care Act of 2017 (H.R. 1215) caps plaintiff non-economic damages in medical malpractice lawsuits at $250,000. Non-economic damages include diminished enjoyment of life, loss of consortium and pain and suffering. A $250,000 award in instances of catastrophic injury or wrongful death would not adequately compensate a medical malpractice victim.

Specifically, the bill's provisions would apply to malpractice lawsuits where coverage is provided through Medicare, Medicaid, or funded via a government subsidy or tax benefit.

Proponents of H.R. 1215 have publicly stated that the bill will save $52 billion in healthcare costs over the next ten years. The bill's supporters contend that the savings would come from a reduction in the cost of medical malpractice insurance premiums and healthcare cost savings.

Opponents of the bill argue that the proposed damage award will unfairly limit what medical malpractice victims are able to recover when they have been injured. Mr. Nadrich notes that "California already has a $250,000 non-economic damages cap for medical malpractice cases. I have seen several instances where a patient is catastrophically injured and $250,000 is woefully inadequate to compensate the victim for his or her injuries."

The pending legislation has far-reaching consequences as the damage award cap would also apply to dangerous drug and nursing home abuse cases. Over eighty organizations currently oppose the bill including Public Citizen, Christopher & Dana Reeve Foundation, and AFL-CIO.
