Mirena IUD Lawsuit News: Rising Popularity of Mirena May Be Cause for Concern, Reports Bernstein Liebhard LLP

As Mirena IUD lawsuits (http://www.mirenalawsuithub.com/) alleging injury due to the spontaneous migration of the device continue to move forward in courts around the country, Bernstein Liebhard LLP notes a new report that highlights the increasing popularity of IUDs, including Mirena. According to The Wall Street Journal, 2.1 million women were using Mirena or another IUD as of 2010, the highest level of use since the 1980s. The report posits that IUD use will continue to grow in the coming years, as the Affordable Care Act now requires that employer-provided health insurance cover the cost of contraception.*

“The Wall Street Journal report does not make any mention of the hundreds of Mirena lawsuits now pending in courts around the country, all of which allege serious injuries due to spontaneous migration of the IUD. Mirena IUD Lawsuits
According to court documents, hundreds of Mirena lawsuits have been filed in litigations pending in both state and federal courts, including at least 300 that have been filed in a multicounty litigation underway in Bergen County Superior Court in New Jersey. (In Re: Mirena Litigation; Case No. 297). Another 296 claims have also been filed in a federal proceeding established in U. S. District Court, Southern District of New York. (In re: Mirena IUD Products Liability Litigation, MDL No. 2434.) All of the lawsuits similarly allege that women suffered serious Mirena complications, including uterine perforations, infertility, and organ damage, when the IUD spontaneously migrated from its proper position in the uterus, despite having been correctly inserted by a healthcare provider. Plaintiffs further allege that Bayer Healthcare Pharmaceuticals failed to provide adequate warnings regarding the risks associated with Mirena, and downplayed its serious side effects.

In addition to neglecting to note the growing number of Mirena lawsuit filings, Bernstein Liebhard LLP notes that The Wall Street Journal article does not mention that Bayer received a Warning Letter from the U.S. Food & Drug Administration (FDA) in December 2009, regarding one of the company’s Mirena promotions. Among other things, the letter stated that the promotion exaggerated the benefits purportedly associated with the IUD, and downplayed the risk for serious Mirena complications.
