Grand jury indictments handed down

Coal Valley News (Madison, WV)

Sept. 24--MADISON -- A Boone County grand jury has returned indictments on 27 individuals on charges from attempted murder to several allegations of illegal drug activity during its September 2015 session, according to documents provided by Boone County Circuit Clerk's Office.

-- Case No. 15-F-125, Eric Neal Kinder was indicted on one count of first degree attempted murder and one count of wanton endangerment involving a firearm after police allege on Feb. 26, 2015, he pointed and fired a Hi-point .45 caliber handgun at Clifford Baldwin.

-- Case No. 15-F-128, Kenneth May was indicted on four counts of third degree sexual assault and one count of sexual abuse by a custodian after police allege he engaged in sexual intercourse with a minor.

-- Case No. 15-F-132, Alan Keith Robinson was indicted on one count of soliciting a minor via computer, one count of sexual abuse by a person in a position of trust and one count of third degree sexual abuse after police allege that between May 27, and June 1, 2015, he lured a minor with his computer and cell phone to meet him where he had sexual contact with the minor after allegedly touching her in over her clothing on her breasts and buttocks.

-- Case No. 15-F-105 and 106, Jerry Wayne Messer and Eric Stevens Hayes were indicted on three counts of grand larceny, two counts of burglary, one count of felony conspiracy and one count of breaking and entering. Police allege the pair broke into a home on Dec. 23, 2014, and someone's garage and outbuildings on Dec. 25, 2014, and another home on Dec. 28, 2014, stealing various items. They also allegedly burglarized a home on Feb. 8, 2015, stealing more items.

-- Case No. 15-F-107 and 108, David Owen Adkins and Alisha Dawn Weekley were indicted on one count each of possession of precursors with the intent to manufacture methamphetamine, felony conspiracy and possession of a controlled substance after police allege the couple purchased pseudoephedrine tablets and conspired to make meth. They also allegedly were in possession of Suboxone.

-- Case No. 15-F-109 and 110, Arthur L. Mooney and Jennifer L. Mooney were indicted on one count of operating a clandestine drug laboratory, one count of felon conspiracy and three counts of possession of precursors with the intent to manufacture methamphetamine after police allege the couple operated a "One Pop" meth lab with pseudoephedrine tablets, lye, a cold pack and rubber tubing attached to a soda bottle lid on Jan. 15, 2015. Also on Sept. 11, Oct. 27, and Dec. 12, 2014, they purchased pseudoephedrine with the intent to make meth.

-- Case No. 15-F-111, 112, and 113, Tyree L. Hicks, James Robert Javins and Sabrina A. Ward were all indicted on five counts each of possession of a controlled substance with intent to deliver, one count of felony conspiracy and one count of gross child neglect creating a substantial risk of injury after police allege on May 20, 2015, they possessed with intent to deliver Heroin, Cocaine, Oxymorphone, Hydrocodone and Xanax. James Robert Javins and Sabrina A. Ward were also charged with have dangerous and deadly controlled substances and firearms around a 8-month-old and 3-year-old children. Tryee L. Hicks was not indicted on that charge.

-- Case No. 15-F-114, Bobby Dean Adkins was indicted on one count of possession of a firearm by a convicted felon. Police allege on April 8, 2015, he was in possession of a Kimber .45 caliber handgun and a Hi-point .380 caliber handgun after having been convicted on the felony offense of attempted robbery in the first degree on May 26, 2006.

-- Case No. 15-F-115, Corey Mark Agosti was indicted on one count of arson and one count of destruction of property, after police alleged that on Dec. 7, 2014, he willfully and maliciously set fire to a 2012 Toyota Tundra belonging to Kirk Burton.

-- Case No. 15-F-116, Earl Bryant was indicted on one count of grand larceny and one count of felony conspiracy after police allege on Aug. 7, 2014, he conspired with another person to stealing several items valued at more than $1,000.

-- Case No. 15-F-117, James Ray Cantley was indicted on one count of first degree robbery and one count of assault during the commission of or attempt to commit a felony. Police allege on June 4, 2015, he beat and then stole cash and beer from Mahendra Vyas.

-- Case No. 15-F-118, Michael Joe Clark was indicted on one count of prohibited person in possession of a firearm after police allege on Nov. 19, 2014, he was in possession of a .40 caliber handgun after being convicted of operating or attempting to operate a cladestine drug lab on June 7, 2006.

-- Case No. 15-F-119, Billy Joe Clay was indicted on one count of driving revoked for driving under the influence third offense and one count of driving under the influence of alcohol second offense after police allege on Feb. 12, 2015, he was operating a 1996 Ford truck on W.Va. Route 3 in the Comfort area. His blood alcohol level was .122 and .08 is the legal limit.

-- Case No. 15-F-120, Nicole M. Emeott was indicted on three counts of delivery of a controlled substance after police alleged on Feb. 27 and 28, 2015, she delivered marijuana and percocet to another person.

-- Case No. 15-F-121, Michael Franklin Frye was indicted on one count of possession of a controlled substance with intent to deliver and one count of delivery of a controlled substance after police allege on Oct. 21, 2014, he possessed and delivered marijuana to another person.

-- Case No. 15-F-122, Paul Hager was indicted on two counts of delivery of a controlled substance after police allege on June 1 and 3, 2015, he delivered marijuana to another person.

-- Case No. 15-F-123, Matthew Jennings Harrison was indicted on two counts of insurance fraud and one count of fraudulent scheme after police allege on March 1, 2014, he submitted a false claim of property damage to a 2001 Chrysler Sebring LX to Progressive Insurance Company and on March 20, 2014, submitted a false claim of personal injury to Erie Insurance Company arising our of a vehicle collision occurring on March 19, 2014.

-- Case No. 15-F-124, Doy Richard Horner was indicted on one count of grand larceny, one count of fleeing from an officer and one count of felony conspiracy after police allege on Jan. 2, 2015, he stole 200 feet of schedule 40 cable belonging to Alpha Natural Resources. When county deputies attempted a traffic stop, he fled on foot.

-- Case No. 15-F-126, Timothy Alan Lambert was indicted on one count of damage and destruction of public utility property and petit larceny after police allege on Nov. 5, 2014, he cut a section of power line belonging to American Electric Company (AEP) causing the lines to fall in reach of a person and disrupting service to the nearby community and taking copper cable and supporting equipment.

-- Case No. 15-F-127, William Mason was indicted on one count of first degree robbery, one count of petit larceny, one count of wanton endangerment involving a firearm and one count of assault after police allege on Nov. 6, 2014, he presented a .22 caliber rifle and stole two women's purses and also pointed the firearm at employees of Sam's Hot Dog Stand.

-- Case No. 15-F-129, Drema McNeely was indicted on one count of attempting to obtain a controlled substance by fraud and one count of felony conspiracy after police allege on Dec. 20, 2014, after using fraud by attempting to fill a prescription in her deceased husband's name for Xanax at Larry's Pharmacy.

-- Case No. 15-F-130, Harold Keith Mills was indicted on 14 counts of obtaining a prescription controlled substance by fraud after police allege between Sept. 6, 2014, and Jan. 27, 2015, several times presented fraudulent prescriptions for Suboxone films and Adderall to the Danville Rite-Aid.

-- Case No. 15-F-131, Arthur Lee Mooney was indicted on one count of nightime buglary, one count of grand larceny, one count of felony conspiracy and one count of delivery of a controlled substance after police allege on Dec. 23, 2014, he broke a window to a residence and stole various items and also delivered $400 worth of methamphetamine to William Sutphin for assisting in the buglary.

-- Case No. 15-F-133, Wallace Smith, Jr., was indicted on two counts of possession of precursors with the intent to manufacture methamphetamine, two counts of possession of a controlled substance and one count of felony conspiracy after police allege on May 17, 2015, he used coffee filters, pseudoephedrine and a cold pack with the intent to manufacture meth. He was also in possession of Suboxone without a valid prescription. On Aug. 6, 2015, he was in possession of Coleman fuel, matches, Morton salt, coffee filters, duct tape and a hose connected to a lid with the intent to use to manufacture meth.

An indictment is a formal a accusation by a "grand jury" that a person has committed certain offenses. All persons indicted should be considered innocent, until or unless proven guilty in a court of law.
