Part of the conspiracy included Lemley improperly contracting with Medworx Compounding to refer prescriptions to Southern Compounding, paying kickbacks as incentives for independent sales representatives to refer TRICARE prescriptions, selling misbranded over-the-counter medicine and prescription drugs and failing to reverse claims on prescriptions Lemley knew were forged, according to court records.
Regulations prohibit Southern Compounding from subcontracting any of its work, but Southern entered a management agreement with Medworx in early 2015, according to Lemley's plea agreement. Medworx referred prescriptions to Southern Compounding, which filled the prescriptions and billed third-party administrators for them, the plea agreement reads.
