Colonie man admits to unemployment insurance fraud [Times Union, Albany, N.Y.]

Mar. 2—ALBANY — A Colonie man pleaded guilty Thursday to conspiring to defraud the state labor department by obtaining unemployment insurance benefits under the name of another person, including benefits funded by the federal government in response to the pandemic, federal authorities said.

Rocco Resciniti, 50, admitted he provided Carl J. DiVeglia III with the personal identifying information of three people, which DiVeglia used to file false claims through the labor department website, U.S. Attorney Carla B. Freedman's office said. Resciniti admitted that as a result of the fraudulent applications submitted by DiVeglia, the labor department paid $69,718 in unemployment insurance benefits.

As part of his plea agreement, Resciniti agreed to pay $69,718 in restitution to the state.

DiVeglia previously pleaded guilty to fraudulently obtaining $1.6 million in unemployment insurance benefits as part of the scheme. Charges against two of Resciniti's three co-defendants are still pending. A third co-defendant, Christopher Ward, pleaded guilty earlier this year, officials said.

Resciniti will be sentenced July 18.
