Meyers of Enea, Scanlan & Sirignano, LLP in White Plains and Somers, N.Y. recently addressed the legal, financial and long-term care planning implications for prospective retirees at the New York State Bar Association's 2018 Senior Lawyers Section Fall Meeting. With millions of baby boomers coming of age, Mr. Enea and Ms. Meyers urge those nearing retirement to take a proactive role in planning for the future.

The meeting, "The Top 6 Things Both Clients and Attorneys Planning for Retirement Must Understand," marks the latest speaking engagement for Mr. Enea and Ms. Meyers, both highly regarded for their expertise, integrity and fierce commitment to the protection of the rights of seniors, the disabled and their families. Mr. Enea, who lectured on last wills, trusts and advanced directives, also served as the Program Chair.

"Retirement requires an organized plan and strategy," said Enea. "While many of us want to go out with our boots on, doing so without having a plan in place will create significant havoc. Start by physically organizing your affairs. Locate all of the most important legal documents executed over the years. These include your last will as well as any trusts, advanced directives, property deeds, mortgages and notes, insurance policies, bank and investment records, income tax returns, passports, birth certificates, and, if applicable, military discharge records."

A strong leader in Westchester's legal community, Mr. Enea is president of the Westchester County Bar Foundation, a past president of the Westchester County Bar Association, and a past chair of the New York State Bar Association's Elder Law Section. "If one is financially and categorically eligible, the federal/state program providing care for seniors either at home or in a nursing home is Medicaid – a 'means tested' entitlement program that looks at both the resources (savings) and income of the senior to determine eligibility," said Meyers. "A senior who is single is not allowed to have more than $15,150 of savings and no more than $862 per month of income to be eligible. However, spouses are permitted to transfer assets to each other to help meet the financial eligibility requirement."
