Vorys: Dunsizer Quoted in Law360 Story Titled 'Ruling Casts Shadow On Health Plans' Drug Coupon Policies'

Jen Dunsizer, a partner in the Vorys Columbus office, was quoted in a Law360 story on the recent court ruling that overturned the policy that allowed insurance companies to exclude drug manufacturer coupons when calculating a patient's annual out-of-pocket maximum.

The story states:

"There's also the potential for new disputes with individual health plan enrollees who might be looking to see if their plan counts drug manufacturer coupons toward their annual out-of-pocket limits in light of the ruling.

Dunsizer said in the immediate wake of the ruling, it's unclear what policy falls back into place now that the D.C. federal court vacated the 2021 notice as applied to copay accumulator programs: 'So we've got some uncertainty there about what the rule actually is,' she said."
