The lawsuit claims Tristar should have paid its Claims Examiners overtime wages for their time worked in excess of eight hours in a workday and hours worked in excess of forty hours in a workweek. The lawsuit further alleges that the Claims Examiners failed to meet all the criteria under any of the exemptions to overtime pay in California. As a result, the lawsuit seeks an unspecified amount of back overtime pay for the proposed class and other statutory damages and penalties.
