The Insurance Company Priced Your Injury Before You Hired a Lawyer. Here Is How the Model Works.

Sponsored ContentThe Argus-Press

Your claim was priced before you hired anyone. Understanding the model is the first step to moving the number.

Treat an injury claim like the financial instrument the insurer already considers it. Reserves get set, documentation gets discounted, and the assigned value moves on a handful of inputs. One Texas firm employs a litigation chief who spent a decade running that model from the inside.

Few firms can explain that math from the inside. J. Alexander Law Firm, a statewide Texas and Oklahoma practice named the 2026 recipient of the Texas Personal Injury Excellence Award after an independent review of 24 Texas personal injury firms, employs as its Managing Litigation Attorney a lawyer who spent more than a decade on the carrier side: R. Matthew Graham, former insurance defense trial counsel across the Southwest and former Director of Subrogation Litigation for a ten state region of the nation's second largest auto insurer.

What raises a claim's value, and what quietly destroys it

Consistent medical treatment raises value, because the records are the injury as far as a carrier is concerned. Gaps in treatment destroy it, because the defense reads every missed appointment as recovery. Recorded statements given early destroy it, because casual phrases become admissions. Social media destroys it. And documented trial capacity on the plaintiff's side raises it more than any other single factor, because the carrier must reserve for what a jury might do.

Timing compounds everything. A policy limits demand sent with complete documentation and a deadline puts a carrier at risk of owing the full judgment if it guesses wrong and refuses. Sent too early, before the medical picture is complete, the same demand undervalues the case forever. Knowing when the file is ready is judgment that only comes from having priced thousands of claims, on one side of the table or the other.

The trial record that moves the math

Across the ten years examined the firm resolved over 500 matters, and in every case the defense pushed all the way to a verdict, the jury found for its client. That undefeated courtroom run, validated in open court records ahead of publication, carried more scoring weight than any other factor.

The review applied the referral test lawyers use on each other, run through court dockets, verdict reporting services, and the subscription research databases of the profession rather than anything a consumer could pull up.

Founded by United States Marine Corps veteran Josh Alexander under the motto It's Personal, the auto accident injury firm represents people injured in car, truck, motorcycle, rideshare, pedestrian, and workplace accidents, and families pursuing wrongful death claims across Texas and Oklahoma. The team's honors include an Avvo attorney rating, Super Lawyers Rising Stars honors in each year from 2022 to 2026, and membership in both the Million Dollar and Multi Million Dollar Advocates Forums, the latter for life. More than 75 years of combined experience back the record, along with a 4.9 star Google average across 568 plus reviews as of June 2026. Consultations cost nothing, run in English or Spanish, and the firm collects no fee unless it wins.

Issuing the award is Percy Martinez Medical Malpractice Lawyers of Florida, which practices medical malpractice exclusively. The announcement is explicit on independence: no referral, business, or financial relationship exists between the firms, and the recipient did not apply for, pay for, or sponsor the honor. The published methodology details every criterion and data source.
