Police: Video shows man hitting pedestrian in fatal hit-and-run in Round Rock

A man accused in a fatal hit-and-run in Round Rock in April was caught on video hitting the victim and braking before leaving the scene, according to an arrest affidavit.

Cory Ferguson, 31, of Georgetown, was charged Friday with accident involving personal injury or death, a second-degree felony punishable by up to 20 years in prison. His girlfriend, Gabriela Delgado Vela, 27, of Georgetown, was charged with tampering with evidence, a third-degree felony punishable by up to 10 years in prison.

A video showed Cleveland Deshon Elliott at 1:40 a.m. April 17 crossing Gattis School Road at its intersection with Surrey Drive when a driver -- later identified as Ferguson -- hit him with the hood of the front passenger side of a 2019 Nissan Sentra, the affidavit said. The document did not say where the video footage came from.

It said Elliott rolled over the top of the vehicle and off the back of it. Police said they think Ferguson knew he had hit someone because Ferguson briefly braked the vehicle before driving away, according to the affidavit. It said Elliott died that morning at a hospital.

Police, working with Google to find all electronic devices that were in the area of the collision, linked Ferguson's cell phone to the scene, the document said. It said police then learned the vehicle Ferguson had been driving was rented to Delgado Vela by Enterprise Rent-A-Car.

Investigators discovered that Delgado Vela, the mother of Ferguson's child, had filed an insurance claim on the rental car three days after the collision, the affidavit said. Pictures that Ferguson sent for the insurance claim showed damage to the front passenger side of the hood, a broken headlight, tape on the top of the windshield and the roof of the vehicle and a dent in the back quarter panel of the car, the affidavit said.

Delgado Vela told the insurance company in a phone call that the damage happened when she was parked in the parking lot of La Michoacana at 1080 S. Mays St. when another vehicle entered the parking lot and struck her car in the rear, pushing her vehicle into a pole, police said. But when police arrested Delgado Vela on Sept. 19, she said the damage to the vehicle did not happen the way she reported it to the insurance company. She she was at home when Ferguson had the collision on April 17, the affidavit said. It said she told police Ferguson was driving her car and called her on the morning of April 17 saying he was on his way home, according to the affidavit.

Ferguson told her the next day he had hit something with the car but he didn't know what it was, the document said. It said Delgado Vela told police that she and Ferguson drove around Round Rock and Gattis School Road during the days after the collision trying to determine what he hit. Data from Google showed that the couple did drive around the city and Gattis School Road during that time, the affidavit said.

Ferguson, who was arrested on an unrelated charge Sept. 19, told police he was involved in two other wrecks but didn't know anything about the collision that killed Elliott.

Ferguson was being held in the Williamson County Jail on Monday with bail set at $250,000. Delgado Vela was released from jail Sunday after posting bail set at $50,000.
