Washington, DC - Rep. Pete Olson (TX-22) today acted to reform medical mitigation laws by voting for H.R. 1215, the Protecting Access to Care Act. This bill will reduce healthcare costs and provide better access to care for patients. It passed the House by a vote of 218 to 210.
"Time and time again, Obamacare's destructive and costly policies continue to hurt Americans," Rep. Pete Olson said. "The pricy risk of being sued for medical malpractice has forced doctors and physicians to close their doors, leaving patients with fewer choices. States, like Texas, have successfully reformed their medical malpractice system to protect this from happening to their doctors and patients. It's time we reform our medical mitigation laws on the federal level to ensure Americans have the healthcare they deserve. I'm proud the House passed this bill and I urge my Senate colleagues to act quickly.
The Protecting Access to Care Act reforms medical mitigation laws where coverage was provided or financed by the federal government, including through a subsidy or tax benefit. It will establish a $250,000 cap on noneconomic damages, limit the contingency fees lawyers can charge to maximize patient recovery, and establish a fair share rule. The Congressional Budget Office reports this bill will save $50 billion in federal taxpayer funds over ten years.
