North Carolina GOP: Kay Hagan’s Nonexistent Obamacare Accountability

Targeted News Service

RALEIGH, N.C., Feb. 28 -- The North Carolina Republican Party issued the following news release:

It would be a grand understatement to say that Obamacare has been a bit of a sore subject for Kay Hagan as of late.

Hagan cast the deciding vote for Obamacare and falsely promised North Carolinians that they could keep their plans if they like them on no fewer than 24 separate occasions.

But since Obamacare exchanges opened last October, Hagan has mightily struggled to defend her support for the law and explain why she repeatedly lied to her constituents.

In recent months, Hagan has responded to every question about her Obamacare record by either giving excuses, flip-flopping on her previous positions, or flat-out refusing to answer.

Earlier this week, Hagan held a press conference to announce that she is running for re-election. The event turned into a media circus once reporters asked her when she discovered that Obamacare would cause Americans to lose their health insurance plans.

Hagan wouldn't give an answer (https://www.youtube.com/watch?v=0xUbIVl70Ow), and then proceeded to walk out of the building (https://www.youtube.com/watch?v=XI4lsfFoNjc), only to be followed by reporters who repeated (https://www.youtube.com/watch?v=kSypmqZUyEM) the question.

Perhaps the most honest answer Hagan has given was when she begrudgingly admitted that if given a chance to do it all over, she would still vote for Obamacare again.

* "But when pressed about whether she would back the health care law if she had another chance, Hagan said: 'Yeah, I would vote for it again.'" (Manu Raju, "North Carolina's choice," Politico (http://www.politico.com/story/2013/12/north-carolina-2014-kay-hagan-101052.html?hp=f2), 12/12/13)

"Kay Hagan cast the deciding vote for Obamacare, repeatedly lied to us when she told us we could keep our plans, and misled seniors into believing their Medicare coverage wouldn't be cut by Obamacare," said North Carolina Republican Party Chairman Claude Pope. "But now, with 473,000 North Carolinians receiving cancellation notices, families being forced to pay higher premiums, and seniors on Medicare Advantage receiving fewer benefits, Kay Hagan won't answer questions about Obamacare. Although she refuses to hold herself accountable for deliberately misleading North Carolinians, voters will certainly hold her accountable in November."

HAGAN ON BEING ABLE TO KEEP YOUR PLAN UNDER OBAMACARE

WHAT HAGAN PROMISED:

Hagan Told North Carolinians That If The Liked Their Health Care Plans They Could Keep Them Under Obamacare, No Fewer Than 24 Times. [Please refer the end of the release for the full list].

HOW HAGAN VOTED:

In 2010, Hagan Voted To Keep Obamacare's Grandfather Rule, Which Ultimately Caused Millions Of Americans To Lose Their Plans.

* "S.J.RES.39: A joint resolution providing for congressional disapproval under chapter 8 of title 5, United States Code, of the rule relating to status as a grandfathered health plan under the Patient Protection and Affordable Care Act." (S.J. RES. 39, Roll Call Vote #244 (http://ncgop.us2.list-manage2.com/track/click?u=f3100bc5464cbba2f472ddf2c&id=0afadd5b69&e=2b673502d2): Failed 40-59; R: 40-0, D: 0-57, I: 0-2, 9/29/10, Hagan Voted Nay)

THE CONSEQUENCES OF KAY HAGAN'S OBAMACARE LIES

Over 473,000 North Carolinians Received Cancellation Notices.

* "More than 473,000 people in North Carolina have lost their health insurance because of plan terminations, the state insurance department saidSome customers received notices saying their premiums would double, or even triple, under more comprehensive coverage required by the new health law." [Raleigh News & Observer (http://www.newsobserver.com/2013/11/14/3371953/despite-obamas-pledge-future-of.html), 11/14/13]

PolitiFact Named Hagan's Broken Promise As "The Lie Of The Year" For 2013.

* "The debate about the health care law rages on, but friends and foes of Obamacare have found one slice of common ground: The president's 'you can keep it' claim has been a real hit to his credibility." [PolitiFact (http://www.politifact.com/truth-o-meter/article/2013/dec/12/lie-year-if-you-like-your-health-care-plan-keep-it/), 12/12/13]

North Carolinians Were Shocked To See Their Plans Didn't Meet Obamacare Requirements.

* "It's been aggravating to have to the policy that you were perfectly happy with doesn't exist anymore. You can't keep it, you have to go on another planthe Affordable Care Act did not make it very affordable for me." [WRAL (http://ncgop.us2.list-manage.com/track/click?u=f3100bc5464cbba2f472ddf2c&id=0954eb814a&e=2b673502d2), 11/6/13]

* "'Because the President and Congress constantly said if you have health insurance, you're not going to lose your health insurance,' said LaRoque. So LaRoque says she was floored last month when she got a letter from Blue Cross saying her current plan was not compliant with the ACA. It said if she wanted to stay covered, she'd have to change plans." [WTVD (http://ncgop.us2.list-manage.com/track/click?u=f3100bc5464cbba2f472ddf2c&id=401e606590&e=2b673502d2), 10/30/13]

* "Amy Nammack-Weiss of Chapel Hill said her insurance costs would have doubled under the new law. Federal subsidies would keep her family's premium flat, at about $660 a month, but her total out-of-pocket spending cap would increase significantly, from $5,400 to $12,700." [Raleigh News & Observer (http://ncgop.us2.list-manage.com/track/click?u=f3100bc5464cbba2f472ddf2c&id=9335c474b2&e=2b673502d2), 11/14/13]

HAGAN'S RESPONSE TO THE CANCELLATIONS:

Hagan Has Refused To Apologize For Lying To North Carolinians.

* "State Republicans say Senator Hagan should be held accountable for promises she made about the Affordable Care ActTonight, she is issuing no apologies." [WTVD (http://abclocal.go.com/wtvd/story?section=news/politics&id=9318893), 11/8/13]

* "Almost every dollar spent so far take aim at her repeated promise that if you like your health care plan, you can keep it. Turns out, that wasn't true for everyone. When asked about it, Hagan side steps, instead talking about how she's trying to make good on the promise now." [WTVD (http://www.youtube.com/watch?v=ffeMoZlhxNw&feature=youtu.be), 2/24/14]

Hagan Has Blamed Insurance Companies--Not Obamacare--For The Cancellations.

* "Well once again, as I said earlier, it wasn't clear that the insurance companies were selling substandard plans. And then they had to go and cancel that." [Kay Hagan, Press Conference (https://www.youtube.com/watch?v=kSypmqZUyEM), 2/24/14]

PolitiFact Has Rated Hagan's Blame Game As "FALSE."

* "Even if it's technically true that the insurer pulls the plug on a plan, the insurer will only be doing this because the law itself and its implementing regulations have created a context in which, sooner or later, old-fashioned plans will inevitably pass into oblivion -- as the law always intended. We rate the statement False." [PolitiFact (http://www.politifact.com/truth-o-meter/statements/2013/oct/30/valerie-jarrett/valerie-jarrett-says-nothing-obamacare-forces-peop/), 10/30/13]

Hagan Has Refused To Admit When She Discovered That Obamacare Would Cause Cancellations

* "The first-term Democrat has declined to respond to questions about when she knew that policies would be canceled. She was a member of the Senate Health, Education, Labor and Pensions Committee, one of two Senate committees that drafted versions of the health care law in 2009." [Raleigh News & Observer (http://www.newsobserver.com/2013/11/20/3391198/sen-hagan-like-other-democrats.html), 11/20/13]

* "Sen Kay Hagan defends 'Obamacare' but won't say when she learned not everyone would be able to keep their insurance, as promised." [Twitter (https://twitter.com/JonCampABC11/status/405033590335209472), 11/25/13]

* "Asked about it again Monday at a press conference in Raleigh, after she made her re-election bid official at the State Board of Elections, Hagan avoided the question. Pressed on the question two more times as reporters followed her outside to the parking lot, Hagan did not answer. She offered this explanation without further details: 'it wasn't clear that insurance companies were selling substandard policies.'" [Raleigh News & Observer (http://www.newsobserver.com/2014/02/24/3650966/as-she-makes-re-election-bid-official.html), 2/24/14]

* "After filing for reelection this week Sen. Kay Hagan (D-North Carolina) dodged reporters' questions about a broken promise that North Carolinians could keep their insurance policies. Today we asked her again about the estimated 473,000 residents that faced cancellations when the Affordable Care Act, also known as Obamacare, launched last fall and when she knew it might happen. Again Hagan did not answer directly." [WWAY (http://www.wwaytv3.com/2014/02/27/hagan-hedges-obamacare-questions), 2/27/14]

HAGAN ON OBAMACARE'S CUTS TO MEDICARE

WHAT HAGAN PROMISED:

Hagan Originally "Guaranteed" That Obamacare Would Not Cause Seniors To See A Drop In Their Medicare Coverage.

* "When asked about cuts in Medicare as a result of health care legislation, Hagan replied, 'I keep hearing that, and I can guarantee people will not see a drop in their Medicare coverage.'" [Thomasville Times (http://www.hagan.senate.gov/?p=news&id=385), 11/18/09]

Hagan Even Claimed That Cuts To Medicare Advantage Would Make Things "Fairer."

* "Health care reform gradually moves to a fairer payment system for private insurance companies that participate in Medicare Advantage. This will encourage greater efficiency and competition among Medicare Advantage plans." [Kay Hagan, "Health Care Facts (http://www.hagan.senate.gov/files/PPACA/MythFact.pdf)," accessed 2/27/14]

HOW HAGAN VOTED:

Hagan Cast The Deciding Vote For Obamacare, Which Cut Medicare Advantage By Over $200 Billion Over 10 Years.

* "ObamaCare enacted $200 billion in cuts to Medicare Advantage over 10 years" [The Hill (http://thehill.com/homenews/house/198329-gop-presses-obama-on-medicare-advantage), 2/13/14]

In 2009 And 2010 Hagan Voted Against Protecting Medicare Advantage From Those Cuts.

(H.R. 3590, Hatch Motion to Commit, Roll Call Vote #362 (http://www.senate.gov/legislative/LIS/roll_call_lists/roll_call_vote_cfm.cfm?congress=111&session=1&vote=00362), Rejected 57-41: R 39-0; D 57-2, 12/4/09, Hagan Voted Nay)

THE CONSEQUENCES OF CUTTING MEDICARE ADVANTAGE BY $200 BILLION:

526,000 Seniors Have Lost Their Current Medicare Advantage Plans.

* "Some 526,000 seniors -- 5% of Medicare Advantage enrollees -- are losing access to plans they had this year, according to a report this week from the Kaiser Family Foundation. They will need either to pick another private plan or rejoin the old Medicare program. [Investor's Business Daily (http://finance.yahoo.com/news/obamacare-cuts-bite-medicare-advantage-225400802.html), 11/26/13]

Seniors Who Rely On Medicare Advantage Are Already Seeing Fewer Options And Are Losing Their Doctors.

* "Benefits experts say patients are seeing fewer plan choices this year, and more are losing doctors from their insurance coverage networks." [Associated Press (http://www.dailylocal.com/general-news/20131113/4-keys-to-scrutinizing-medicare-advantage-cuts), 11/15/13]

HAGAN'S ELECTION-YEAR FLIP-FLOP:

In 2014, Hagan Co-Signed A Letter To The Obama Administration Expressing "Serious Concerns" Over Cuts To Medicare Advantage Reimbursement Rates.

"We write to raise serious concerns about the Medicare Advantage (MA) 2015 rate notice and the impact further cuts may have on the millions of individuals enrolled in the program. We are strongly committed to preserving the high quality health plan choices and benefits that our constituents receive through the MA program. Given the impact that payment policies could have on our constituents, we ask that you prioritize beneficiaries' experience and minimize disruption in maintaining payment levels for 2015."

HAGAN ON OBAMACARE'S MEDICAL DEVICE TAX

HOW HAGAN VOTED:

Hagan Voted For Obamacare, Which Imposed A 2.3 Percent Tax On The Sale Of Medical Devices. (H.R. 3590, Roll Call Vote #396, Adopted 60-39: R 0-39; D 60-0, 12/24/09, Hagan Voted Yea)

In March 2010, Hagan Voted To Kill An Amendment That Would Have Repealed The Medical Device Tax. (S. Amdt. 3579 to H.R. 4872, Agreed to 56-42, 3/24/10, Hagan Voted Yea)

THE CONSEQUENCES OF THE MEDICAL DEVICE TAX:

An AdvaMed Survey Found The Tax Has Already Destroyed 33,000 Industry Jobs And Could Eventually Cost As Many As 165,000 Jobs.

* "The tax has resulted in employment reductions of approximately 14,000 industry workers and forgone hiring of 19,000 workers. The total job impact of the tax on industry employment was approximately 33,000.Applying this ratio to jobs lost or foregone suggests that the impact of the tax on indirect employment would be approximately 132,000 jobs, for a total job loss due to the tax of as many as 165,000 jobs." [AdvaMed (http://advamed.org/res.download/417), 2/14]

HAGAN'S ELECTION-YEAR FLIP-FLOP:

In Late 2013, Hagan Signed-On To A Bill To Repeal The Medical Device Tax.

* "Sen. Kay Hagan, the Democratic U.S. senator from North Carolina, just became the 36th co-sponsor of S232, a bill that would repeal the 2.3 percent tax." [Triad Business Journal (http://www.bizjournals.com/triad/blog/2013/09/hagan-signs-on-to-medical-device-tax.html), 9/23/13]
