Naples man charged with white-collar crime over a decade ago is back in jail

A Naples insurance agent convicted of an aggravated white-collar crime more than a decade ago is back in jail. He is also delinquent in restitution fees he was ordered to pay the 22 victims who included his mother.

In 2011, Kenneth J. Elliott, 41, pleaded no contest to aggravated white-collar crime with at least 20 victims involving more than $50,000 and scheme to defraud, both first-degree felonies, and uttering a forged instrument, a third-degree felony.

He was sentenced to 11 years in Florida State Prison followed by 15 years of probation. He was ordered to pay $69,891.51 in restitution to his victims, including $742 to his mother.

The owner of Elliott & Associates was first arrested in March 2010 after providing a fictitious insurance policy to a Golden Estates man, pocketing the $862 premium and writing a bogus letter and check to conceal it. Three weeks later, a Bonita couple discovered their insurance policy was bogus and alerted the state Division of Insurance Fraud.

Most of his victims were homeowners and businesses he stole money from by selling bogus insurance policies.

He faced 30 years, but a pre-sentence report recommends five. Elliott, who lost his license, was given some time to find a job to pay restitution for the yearly premiums he took from more than 20 people and businesses, including Snapper's and Vision Nightclub.

After his release, he was expected to continue paying his victims back.

He got out of prison in May 2018 and is currently scheduled to terminate his supervision in 2033.

On March 23, 2021, while on probation, Elliott was ordered to appear in Palm Beach County Court, accused of leaving the scene of an accident. As a result, Collier County issued a warrant for his arrest for violation of probation with a "no bond" hold, records show.

Although he claimed to be in close contact with his probation officer, he still had not surrendered to police on the outstanding warrant, despite knowing that it existed, according to court records. By Sept. 27, he remained at large and the arrest warrant had not been served on him.

The warrant was served on Oct., 12 and his first appearance hearing was set the following day. At the hearing, he filed an application for indignant status and request a public defender. He claims to have zero income, zero social security benefits, zero retirement savings.

He does not have any assets.

He has no money in his bank account according to his application and he does not own a car.

Court records show that as of April this year he had paid roughly $11,000 of the total required $69,585 restitution amount ordered over a decade ago. Out of a total of $1,397 in court fees, he still has to pay $1,302.

His cost of supervision is $9,000, and he has not paid back any of it.
