SECTION II. Chapter 16, Public Facilities and Utilities, Article 1, Municipal Utility Systems, Section 16-7 of the Code of Ordinances of the
(a) If the accuracy of record of a water meter is questioned by the owner or occupant of premises served by the meter, the owner or occupant may request a test to be made. The request shall be accompanied by a deposit with the Town Treasurer in the amount of
(b)The meter may, at consumer's request, be removed and tested in the Grandfield Public Works Shop or by a third party with a contract with the
(c)Findings resulting from the test shall be conclusive as to both the consumer and the Town.
(d)If the test discloses an error of registration of more than three percent against the consumer: (1) the amount of the excess registration shall be imputed to the consumption as registered and shown by the three previous meter readings and shall be credited for the period to the consumer's meter account; (2) the Town shall bear the entire cost of the test and return to the consumer the full amount of his deposit made for the test.
(e) If less than three percent error is found by the tests, the consumer requesting the test shall pay the test charge.
SECTION III. The remaining portions of Chapter 16, Public Facilities and Utilities, Article 1, Municipal Utility Systems, shall be unchanged by this ordinance.
SECTION IV. Repealer. All former ordinances and/or parts of ordinance conflicting or inconsistent with the provisions of this Ordinance are hereby repealed.
SECTION V. Savings Clause. Nothing in this Ordinance hereby adopted shall be construed to affect any suit or proceedings now pending in any court, or any rights acquired or liability incurred, nor any cause or causes of action accrued of existing, under any act or Ordinance repealed hereby. Nor shall any right or remedy of any character be lost, impaired, or affected by this Ordinance.
SECTION VI. Severability. If any section, subsection, sentence, clause, phrase, or portion of this ordinance is, for any reason, held invalid or unconstitutional by any court of competent jurisdiction, such portion shall be deemed a separate, distinct, and independent provision, and such holding shall not affect the validity of the remaining portions of this ordinance.
