Former teacher sex case set for arraignment

Aug. 31--MOULTON -- A former Moulton Middle School teacher will have an arraignment hearing Sept. 7 after being arrested in late May for allegedly having sex with a high school student.

A Lawrence County grand jury recently indicted Taylor Brooks Boyles, 27, 5216 Lawrence County 87, Moulton, who was charged May 22 with being a school employee engaging in a sex act or deviant sexual intercourse with a student under the age of 19.

The charge is a Class B felony, which is punishable by two to 20 years in prison and up to $30,000 in fines.

The arraignment will be before Lawrence County Circuit Judge Mark Craig at 9 a.m.

Lawrence County Sheriff Gene Mitchell said the alleged victim was an 18-year-old high school senior.

Boyles was a fifth-grade math and social studies teacher at Moulton Middle. She submitted her resignation May 18, according to Superintendent Jon Bret Smith. At a school board meeting May 22, Boyles' contract was non-renewed.

Boyles has hired Mark Dutton, of Moulton, as her defense attorney, court records show.

In mid-August, Morgan County Circuit Judge Glenn Thompson ruled the 2010 law prohibiting school employees from having sex with students under the age of 19 was unconstitutional and dismissed the charges against Decatur High teacher Carrie Witt and former Falkville High contract teacher David Solomon. His ruling, which has been appealed, is not binding outside Morgan County.

Winfield Sinclair, an assistant Alabama attorney general, said in defending the 2010 law that the state has reasonable and rational grounds to protect schoolchildren from a teacher who views students as "expanding the dating pool."
