The American Med Spa Association (AmSpa) to Host Seminar Addressing the Recent Changes to Texas Law Affecting Medical Spas, Medical Directors, Nurses and Estheticians

The new Texas Medical Board (TMB) rule, codified in November of 2013, requires a comprehensive 10 step procedure to be in place at medical spas and dramatically changes supervising physician responsibilities and delegation of medical procedures. The rule, TMB Rule 193.17, relates to nonsurgical medical cosmetic procedures (e.g., injection of medication or substances for cosmetic purposes and the use of prescription medical devices, such as lasers, for cosmetic purposes) and directly affects the Texas aesthetic industry.

"This new rule changes the playing field for medical spas in Texas," said Alex Thiersch, Director of AmSpa. "It is imperative that all aesthetic professionals in Texas know the new rules so that they operate safely, responsibly, and in compliance with Texas law."

According to Thiersch, a number of AmSpa members in Texas have requested information on the new rules and guidance on how to comply with the changing med spa landscape. The May 7th seminar, hosted at the offices of the law firm Strasburger & Price, LLP "Strasburger", will allow attendees to learn about the new rules from qualified and experienced health care attorneys.

The main focus of the seminar will be to deconstruct the new rules and explore their impact on the aesthetic community. According to Stuart Miller, one of the attorneys at Strasburger who will be presenting on the new rule, the impact of the new rules could be significant. According to Miller, "Medical spas will no longer be able to perform nonsurgical medical procedures without having a physician, a nurse practitioner or physician assistant on staff to complete a ten-step process before beginning the procedure."

Other topics covered will include the medical documentation, including written office protocols, that are mandated by the new rule; the responsibilities of a medical director; and new rules on supervision and delegation of medical treatments. There will also be time for attendees to ask pertinent questions about their med spa practice, and have direct interaction with attorneys and other health care professionals about the issues affecting the med spa industry.

According to AmSpa Marketing Director Gina Meyer-Shaffer, workshop tickets are currently on sale for $39 for members, $69 for non-members and $139 for non-members with an annual membership ($86 savings). The workshop will be held from 1:00 p.m. to 5:00 p.m. at 909 Fannin Street, Houston, Texas.
