Plaintiffs Emerging Victorious in Several Transvaginal Mesh Lawsuits, Baron & Budd Reports

Millions of Dollars Awarded to Women Injured After Implantation of Transvaginal Mesh Devices

DALLAS--(BUSINESS WIRE)-- Recent months have seen significant victories for plaintiffs in transvaginal mesh device lawsuits, the national law firm of Baron & Budd reports. Plaintiffs have been awarded millions of dollars in compensation for serious injuries they suffered after the implantation of the device. Thousands of transvaginal mesh device lawsuits are pending as part of multidistrict litigation before U.S. District Judge Joseph R. Goodwin of the United Stated District Court, Southern District of West Virginia. (In Re: MDL No. 2327, MDL No. 2187, MDL 2326)

On March 16, a plaintiff was awarded a $5.7 million verdict in a suit against Johnson & Johnson subsidiary Ethicon, Inc., a transvaginal mesh device manufacturer. Ethicon also settled a case on March 6 in a separate lawsuit involving a mesh device recipient. Details of the settlement were not released. Mesh device manufacturer C.R. Bard also settled a lawsuit in February. Again, the details were kept confidential.

Last September, a jury in West Virginia awarded a plaintiff $3.3 million in a case against Ethicon. The same month, another transvaginal mesh implant recipient was awarded $73 million by a Texas jury ($23 million in compensatory damages and $50 million in punitive damages) in a case against device manufacturer Boston Scientific Corp.

Transvaginal mesh devices are designed to treat stress urinary incontinence, pelvic organ prolapse and other women’s health issues. However, many devices have eroded, leading to serious complications that include bladder and bowel perforation, infection, bleeding and severe pain.
