This warning comes after a bail bondsman from California was charged with a number of weapons violations and another from Arkansas was arrested for accepting prescription medication as payment for bonds.

Most recently, a bail bondsman from Sacramento, California has been criminally charged with a number of weapons violations for taking guns instead of money from those looking to get out of jail. “Unfortunately, some of the more unscrupulous bail bonds companies rely on high volume to fuel their business. This can lead to them aggressively seeking out clients using low down payments, or even alternate payment offers, in an attempt to corner the market,” Schuder adds. “This can look like an attractive option at first; after all, when a loved one is arrested, families experience a lot of stress, anguish, and grief and just want to see the person out of jail. That can leave them feeling desperate and susceptible to bail bond scams and fraud.”

According to Schuder, one of the more popular scams is offering significant discounts on the bail bond. In most cases, a defendant pays the full bond premium, which is usually 10%; a $100,000 bond with a 10% cash option would mean paying the bail bondsman $10,000. To get a client, a dishonest bail bondsman might only require a three percent payment up front, getting the rest on a payment plan. The lower up-front cost makes it easier for defendants to get out of jail.

Offering illegal discounts not only gives the bail bonds industry a black eye, Schuder explains, but it also endangers the community and undermines faith in the system. The cut-rate and substitute payment deals make it harder to ensure a defendant will return for their trial, which is the backbone of the bail bonds industry.

“From an ethical standpoint, potential clients need to ask themselves, ‘what kind of business is this person operating?’” he concludes. “There are many reputable bail bondsmen that offer financing for the full amount, and while it might seem like a big up-front expense, it’s better to deal with an honest bail bondsman with a proven track record of treating their clients with respect.”
