Jury sides with ex-Hawkeye Boyle, wife in crash lawsuit [Waterloo-Cedar Falls Courier, Iowa]

April 26--TAMA, Iowa -- A Tama County jury has sided with a Reinbeck couple who took their insurance company to court in connection with a 2008 crash.

Dawn Boyle and her husband, Kevin, sued Allied Property and Casualty when the insurance carrier allegedly didn't pay on the Boyles' uninsured motorists policy.

The case went to trial April 9, and on April 13 the jury returned a $249,920 verdict in favor of the Boyles, said Attorney David Dutton, who represented the couple. Jurors found Dawn Boyle was 20 percent responsible for the crash, so the award will be reduced to reflect that.

Kevin Boyle, who sued for loss of consortium in connection with his wife's injuries, had played basketball for the University of Iowa in the 1980s and was drafted by the Philadelphia 76ers. He currently sells insurance and does radio play-by-play for the University of Northern Iowa men's basketball team.

The accident happened in October 2008 in a construction zone near Gladbrook when Dawn Boyle was returning home from her job in Marshalltown. She was rear-ended by a vehicle driven by Ashley Araiza, Dutton said. He said Araiza wasn't insured at the time.

Dutton said the impact aggravated an earlier injury, and Dawn Boyle suffered a permanent injury. At trial the insurance company disputed the injury, Dutton said.
