Mostyn Law scores another victory for hurricane victims shortchanged by insurers

HOUSTON, Oct. 21, 2016 /PRNewswire/ -- Eight years after Hurricane Ike tore through their Port Arthur home, Rene Lampson and Justina Henriquez Lampson will finally get the compensation they are due from their insurance company.

In a ruling issued on Monday, the Ninth Court of Appeals in Beaumont upheld a jury's decision that National Security Fire & Casualty owes the Lampsons $388,698 for improperly handling their claim for damage inflicted by the hurricane. The trial court jury concluded that the insurance company knowingly failed to investigate the claim and pay for the damages it owed.

"After being victimized by Hurricane Ike, Rene and Justina were victimized again by their own insurance company. We see this repeated victimization, not just in Texas, but practically after every weather related catastrophe in the country," Gregory Cox, the lead trial and appellate counsel said. "It is good to know that justice has finally prevailed in this case.  I hope other victims will realize they can stand up against the insurance companies.  There are people willing to stand with them and fight for their rights."

The Port Arthur case went to trial in 2014 in the 136th District Court in Beaumont. The insurance company appealed the unanimous jury verdict in favor of the Lampsons.   The Court of Appeals unanimously upheld the entire jury verdict, including an award to punish the insurance company for its knowingly unlawful conduct.

The appellate case is styled National Security Fire & Casualty Company v. Rene Lampson and Justina Henriquez, 09-15-0029-CV, Ninth Court of Appeals, Beaumont, Texas.
