Insurance Law Podcast Discusses Negligent Security Claims
This episode discusses negligent security claims, which are usually a result of a criminal act that happens on a commercial property, e.g., someone is robbed or assaulted in a parking lot. The claims are generally based on the victim's belief that the individuals and property owners who invite people onto their property have a reasonable duty to ensure that the property is safe. The claims are often complex, costly and have multiple defendants, such as the property owners, property management companies and security companies. The best defense against these claims is to adhere to a security plan that is appropriate for the property and update as needed. All parties involved should keep meticulous records and be aware of any contractual relationships that could be used as a basis of a cross claim for indemnification and defense.
