Statement From Freed & Weiss LLC Regarding Title Insurance Companies Facing Class Action Suits Over Charging Premiums in Excess of Filed Rates for Mortgage Refinancing
CHICAGO and DETROIT, July 7 /PRNewswire/ -- The following statement was issued today by the law firm Freed & Weiss LLC:
A Detroit federal court refused to dismiss a lawsuit brought by a homeowner who alleged that, when he refinanced his mortgage, he was overcharged for "title insurance" by Transnation Title Insurance Corporation, a wholly owned subsidiary of LandAmerica. Hoving v. Transnation Title Ins. Corp., 07-cv-15322(E.D. Mich.)
Although title insurance companies are required by law to impose set premium rates for title insurance policies, they routinely charge customers well in excess of these rates when homeowners refinance their mortgages, the suit alleges. The Transnation lawsuit is identical to similar class action lawsuits that Freed & Weiss has brought or investigating against other title insurance companies, including First American, Fidelity, LandAmerica, Lawyers Title, Chicago Title, Commonwealth and Ticor Title.
