The U.S. Department of Energy (DOE), Office of Independent Enterprise Assessments (IEA), intends to modify an existing contract with Eagle Research Group, Inc. The purpose of the modification is to increase the estimated level of effort/Direct Productive Labor Hours (DPLH) and contract value for the remaining four contract option years from May 2014 through May 2018. Contract number DE-HS0000086 with Eagle Research Group, Inc was awarded on a competitive basis on May 16, 2013.Contract DE-HS0000086 provides technical support for several offices within IEA in supporting the DOE Secretary s agenda for oversight and assessment of security, safety and health procedures and programs at DOE facilities. This technical support includes independent assessment of the effectiveness of the Department of Energy s safeguards and security, emergency management, cyber security, environment, safety, health and other critical functions, policies and site performance areas. Changes have occurred that have an impact on the amount of services (level of effort) to be provided by the contractor. The first significant change was mandated by the DOE Secretary Moniz and the Chief Health, Safety and Security (HSS) Officers to provide support through the Eagle contract to the U.S. Nuclear Regulatory Commission (NRC). The nature of the services, technical and logistical support for force-on-force security exercises at nuclear facilities are essentially the same as that p rovided to IEA for such exercises at DOE nuclear facilities, and clearly within the services described in the Performance Work Statement.

The second and most significant change is the increased priority placed on oversight and enforcement by DOE Secretary Moniz with the creation of the new Office of Independent Enterprise Assessments (IEA), formed out of the elements of the HSS organization that this contract supports. Secretary Moniz has clearly stated that IEA will serve as one of his most important leadership tools, and will report directly to the Office of the Secretary. IEA will provide objective, fact-based assessments of matters of priority concern, as well as recommendations for improvement that are practical and timely, serving as an important check-and-balance that meets the Department s responsibilities as a self-regulating entity. IEA s top priorities will include but will not be limited to security and safety issues. IEA will be responsible and accountable for meeting Federal regulations and directives in the areas of independent oversight as well as safety and security enforcement. IEA has be en tasked to undertake: 1) analyze DOE operations for risk management and performance; 2) perform regulatory enforcement as required by federal statute; 3) conduct assessments and investigations, analyze results, and report findings and recommendations to the Secretary and Deputy Secretary; and 4) prepare reports and share lessons learned pursuant to the Secretarial guidance. These changes directly result in IEA increasing the quantity, depth and breadth of its assessment schedule across the complex.

The statutory authority for permitting other than full and open competition for this contract modification is Section 303[c][l] of the Federal Property and Administrative Services Act of 1949, as amended by the Competition in Contracting Act, 41 USC 253 [c][1], and implemented by FAR 6.302-l[a][2], authorizes other than full and open competition when there is only one responsible source and no other supplies and services will satisfy agency requirements. Eagle is the only source uniquely qualified to perform the services desired by the Department of Energy given their required technical, analytical, management and planning expertise in safeguards and security, emergency management, cyber security, environment, safety, health and other critical functions and policies described above to successfully assist the Federal staff in accomplishing the mission of IEA. The contractor personnel currently possess directly related work experience to support its claim that it can successf ully assist the Federal staff in accomplishing the stated mission and requirements outlined in the Performance Work Statement including the said mentioned increase. Performance shall commence immediately after the date of the contract modification.

This is a notice of intent of a contract modification and not a request for competitive proposals. No solicitation is available for this requirement. If a firm believes that DOE should not pursue this sole source procurement with Eagle Research Group, Inc., then they should submit a capability statement and pricing information for the requirement by 12:00pm EST on September 10, 2014. A determination by the Government to compete this proposed contract based upon responses to this notice is solely within the discretion of the Government.
