A.M. Best Co. has released the 46th episode of the Insurance Law Podcast, a series that examines timely and important legal issues affecting the insurance industry, from an attorney’s point of view.
Episode 46 features attorney Chris Massenburg from the law firm Swetman Baxter Massenburg, with offices in Hattiesburg, MI and New Orleans, LA, discussing the state of federal asbestos MDL litigation. Massenburg is a founding member of the firm and manager of its Hattiesburg office. His practice focuses on environment, toxic tort, product liability, construction and commercial trucking litigation.
In episode 46, Massenburg explains the history of asbestos liability litigation from the 1970s until today and the role of MDL 875 Asbestos Product Liability as a settlement docket for unresolved asbestos-related claims. Emphasis is given to the recent accomplishments of Federal District Judge Eduardo Rebreno, who has cleared approximately 8.5 million old claims from the MDL docket in the last two years. Given that there are more than 40,000 old cases remaining, Massenburg theorizes on the future of asbestos liability litigation and its impact on the insurance industry.
