Man threatens to choke mother

Sept. 11--Herman Lee Brown II, 37, of Man, was arrested by the West Virginia State Police on September 6 for domestic battery and domestic assault.

According the the WVSP, Senior Trooper R.L. Glaspell responded to a domestic disturbance in the community of Landville on Sept. 6. Upon arrival, Glaspell spoke to the victim, Brown's mother, who allegedly claimed she was in an argument with her son over him wanting money when he choked her.

Police say that Brown admitted to pushing his mother in the chest.

A criminal history showed the defendant to have two pending, prior domestic battery charges, one pending domestic assault charge and one guilty domestic assault charge.

Brown's bail is set for $5,000.

-- The WVSP conducted a warranted arrest on Mellisa Packo, 43, of Mount Gay, on September 7. Packo faces an embezzlement charge that dates back to April 10.

On April 10, the WVSP received a public service from the Rich Oil Gas Station in Cora in reference to a customer stealing money. The officer obtained a copy of the video surveillance from the store which allegedly show Packo taking money from the cash register on two different occasions.

Packo reportedly stole $849 on April 10 and $969.75 on April 11.

Packo's bail is set for $3,500.

-- William Hubert Sammons, 50, of Accoville, was arrested by the WVSP on September 8 for driving with a revoked license for DUI, DUI (third offense), defective equipment and no proof of insurance.

On September 8, Trooper First Class J.K. Harris reportedly observed a gray Chevrolet Impala traveling on Buffalo Creek Road near Accoville with a defective registration light.

Harris initiated a traffic stop as the vehicle pulled onto Afton Street.

Harris made contact with the driver, Sammons, who allegedly failed to produce a valid driver's license and a valid proof of insurance. Harris reports that he detected an odor of alcohol emitting from the passenger compartment of the vehicle; he also allegedly observed an open Budweiser been can in the center cup holder and two empty beer cans in the passenger side floor.

Harris reports that Sammons appeared to have slurred speech and bloodshot/glassy eyes. As Sammons exited the vehicle and walked to the back of the car, Harris allegedly observed Sammons to have an unsteady gait. Additionally, upon speaking to Sammons outside of his vehicle, Harris claims he detected the odor of an alcoholic beverage emitting from Sammon's person.

Sammons agreed to a series of Standardized Field Sobriety Tests, which Harris reports Sammons performed unsatisfactorily.

Sammons was trasported to the WVSP Logan Detachment for processing where he agreed to a chemical test. This test reveled his BAC was .127 percent.

Sammons' bail is set for $7,500.

-- Justin Paul Rice, 32, of Chapmanville, was arrested by the WVSP on September 4 for driving with revoked license for DUI (fourth offense), obstructing, possession of marijuana (more than 15gm), possession of a controlled substance and expired MVI.

On September4, Trooper J.E. Garren was performing routine road patrol when he allegedly observed a black Ford Expedition traveling on Holden Road. Earlier that day, Garren says he was notified by an anonymous source that Rice would be in the Cora/Holden area driving the described vehicle.

Garren initiated a traffic stop on the vehicle. While he was approaching Rice, the driver, Garren allegedly observed Rice reaching around in the vehicle. Garren reportedly told the defendant to stop reaching under the seat and to put his hands on the steering wheel; Rice allegedly did not comply to Garren's commands.

Garren then allegedly observed Rice place something into his mouth and begin chewing. Garren immediately advised Rice to spit out the item; Rice did comply to this command. Garren placed Rice into custody without further incident.

However, Garren did notice that Rice's MVI sticker had expired on 4/2014. Garren requested a driver's inquiry through WVSP dispatch and was reportedly advised that Rice's license was revoked for a previous DUI from July 2013 and a previous conviction of driving revoked for DUI in August 2013, as well as two pending driving revoked for DUI charges from January and April of 2014.

During a search of Rice's vehicle, Garren allegedly located a small, clear plastic baggy containing a green, leafy substance believed to be marijuana, and another clear plastic baggy containing 16 Adipex pills, a schedule IV controlled substance. Reports also claim that the clear plastic baggy Rice was trying to eat contained Xanax pills.

Rice's bail is set for $30,000.
