EMove Found Guilty of Unfair and Deceptive Trade Practices Against Plaintiff SiteLink Software LLC

The United States District Court for the Eastern District of North Carolina Western Division, NO. 5:08-CV-403-FL, SiteLink Software LLC et al vs. EMove, Inc., EMove was found guilty of Unfair and Deceptive Trade Practices against plaintiff SiteLink Software LLC (SiteLink). The jury awarded SiteLink $1.7 million as part of their verdict.

This case stems from a series of brochures and comparison charts created and distributed by EMove between 2004 and 2009. According to case number 5:08-cv-00403, these charts falsely inflated the cost of SiteLinkTM and misrepresented SiteLink's smart management software features. Case number 5:08-cv-00403 states that EMove's brochures claimed that their software "blows away the competition." The distribution of these brochures at tradeshows and by U-Haul area field managers continued for more than two years after EMove was notified by SiteLink as to their false and misleading nature.

According to the plaintiffs, these charges and brochures contain several misrepresentations about SiteLink inflating their price and erroneously representing that SiteLink does not:

   •  Support real-time confirmed reservations
   •  Include integrated credit-card processing
   •  Include upgrades in the purchase price
   •  Include integrated tenant insurance
   •  Fully integrate online-payment processing
   •  Include fully integrated call-center service
