Disability Denial Lawyer Airs Insurance Company Deceptive Practices

A recent Senate hearing addressed the deceptive practices that have been used by long-term disability insurance companies, and regulations put in place by the Employee Retirement Income Security Act (ERISA). Other issues include the fact that there is little downside for the insurance carrier in denying claims, since the claimant is denied basic state law remedies such as claims for bad faith insurance practice, punitive damages, actual damages, deceptive trade practice acts violation and an effective way to recover their attorney fees. In short, if the insurance company loses in court, all they usually have to pay is what they should have paid for in the first place.
