April 02--One of the passengers involved in a Memorial Day boat wreck filed suit against the vessel's insurance companies.
Morgan Nicole Gerdon filed suit in Harrison County this year. The filing was recently added to the case filing of a Monongalia County Circuit Court case.
According to the Gerdon case: She was a passenger and injured in the crash, though the suit doesn't list specific injuries.
It asks a court for an order that the insurance companies provide all liability insurance coverage, all medical payments and any other coverage for the wrongful acts of the Solomons. The suit does not state a specific dollar figure for damages suffered by Gerdon.
On Memorial Day, Brandon Solomon crashed a boat on Cheat Lake, injuring himself and his 11 passengers. The passengers had varying degrees of injuries, but all required trips to a hospital and three had to be flown by helicopter.
Solomon was charged with 11 counts of boating while intoxicated causing injuries, not having enough life vests and improper registration. His criminal case remains active.
Several passengers filed civil suits against Solomon and his father, Steven Solomon, who they say owned the 25-foot boat. The civil suits have been combined into one case. The passengers said Brandon Solomon was speeding and was under the influence of drugs and/or alcohol when he crashed. They also said Steven Solomon knew his son's condition.
Brandon Solomon pleaded the Fifth Amendment against self-incrimination in response, and Steven Solomon denied the allegations.
