Vanderbilt Employee Sues After Being Denied Gender-Affirming Care Coverage

A Vanderbilt University employee is suing the school for alleged discrimination after the university denied insurance coverage for gender-affirming procedures.

Hannah Housden, a transgender woman and faculty member in Vanderbilt's college of arts and sciences, filed the lawsuit in federal court Sept. 1. In 2024, her physician submitted an insurance claim to use Housden's employee health plan provided by Vanderbilt to cover the cost of surgical facial feminization procedures.

According to the lawsuit, insurance provider Aetna initially denied coverage, saying the procedure was not "medically necessary" — despite Housden's physician claiming otherwise.

Housden appealed the denial to Vanderbilt, which gets final say on whether to approve coverage. Vanderbilt denied the claim, also stating the surgery would be cosmetic rather than medically necessary. The lawsuit notes that the World Professional Association for Transgender Health considers facial feminization procedures as medically necessary.

Vanderbilt's employee health insurance plan does not exclude all types of facial work from insurance coverage, but does exclude certain facial procedures done as treatment for gender dysphoria, the legal complaint says. The suit also notes Vanderbilt offers gender-affirming care benefits to students, who are able to receive facial feminization and masculinization procedures.

Housden is suing Vanderbilt for sex discrimination, as well as disability discrimination due to her diagnosis of gender dysphoria. The lawsuit alleges Housden received "disparate treatment because of her sex, inclusive of gender identity ... treating her less favorably than cisgender individuals."

"[Vanderbilt] widely publicizes itself as a positive place for LGBTQ students and staff, based on various non-discrimination policies it has adopted, but chose to violate its own anti-discrimination policies with respect to Ms. Housden," the lawsuit reads.

"At one time [Vanderbilt] publicized a 'Transgender Tool Kit' to help support transgender employees and students but on information and belief stopped doing so approximately two years ago."

Housden is represented by Nashville-based Rubenfeld Law Office. She is suing for declaratory and injunctive relief, a well as monetary damages.

In February, Vanderbilt University Medical Center stopped offering gender-affirming surgeries for adults. Gender-affirming care for minors is banned in Tennessee. In 2025, Vanderbilt's health programing for members of the LGBTQ community was gutted after more than 600 employees were laid off from VUMC. TennCare does provide insurance coverage or reimbursement for gender-affirming surgeries or treatment.

Meanwhile, the Tennessee General Assembly's Republican supermajority passed a law this year to track transgender healthcare data. The law requires the Tennessee Department of Health to produce a public report listing the number and nature of gender-affirming treatments across the state. The sponsors of the legislation, outgoing state Rep. Jeremy Faison (R-Cosby) and state Sen. Brent Taylor (R-Memphis), have said that the identifying information of patients will not be shared. Additionally, the bill requires insurance companies that cover gender-affirming care to also cover detransition treatment.

Vanderbilt did not respond to the Post's request for comment.
