SWB Yankees insurance dispute sent back to county court

Oct. 6--A lawsuit filed by the owners of the Scranton/Wilkes-Barre RailRiders against insurance companies that denied a claim for pandemic-related losses has been transferred back to Lackawanna County Court from federal court.
SWB Yankees LLC filed suit in June against CNA Financial Corporation and Continental Casualty Company, both of Chicago, and Continental Insurance Company of Radnor. The suit alleges the companies wrongly denied a claim for business losses sustained due to coronavirus pandemic restrictions.
The lawsuit was filed in Lackawanna County Court, but attorneys for the defendants transferred the case to federal court because the parties involved are located in different states. That gives federal courts authority to take jurisdiction over the dispute.
Attorneys for SWB Yankees fought the transfer, arguing the case should be decided in county court because at least one of the defendants is located in Pennsylvania. U.S. District Judge John E. Jones recently granted the request to remand the case back to county court.
