This amendment does not change the Legis-latures constitutional authority to require no-tification to a parent or guardian before a mi-nor has an abortion. Financial and State Budget Impact State-ments The proposed amendment would result in significantly more abortions and fewer live births per year in Florida. The increase in abortions could be even greater if the amendment invalidates laws requiring parentel consent before minors undergo abortions and those ensuring only licensed physidans perform abortions. There is also uncertairity about whether

the amendment will require the state to subsidize abortions with public funds. Litigation to resolve those and other uncertainties will result in addition-al costs to the state government and state courts that will negatively impact the state budget. An increase in abortions may nega-tively affect the growth of state and local rev-enues over time. Because the fiscal impact of increased abortions on state and focal revenues and costs cannot be estimated with precision, the total impact of the pro-posed amendment is indeterminate. (8) Nothing in this section shall affect or re-peal laws relating to negligence or profes-sional malpractice on the part of a qualified patient, caregiver, physidan, MMTC, or its agents or employees. fl) DUTIES OF THE DEPARTMENT. The Department shall issue reasonable regula-tions necessary for the implementation and enforcement of this section. The purpose o1 the regulations is to ensure the availability and sme use of medical marijuana by quali-fying patients. It is the duty of the Depart-ment to promulgate regulations in a timely fashion. (1) Implementing Regulations. In order to al-low the Department suffident time after pas-sage of this section, the tollowing regulations shall be promulgated no laferlh^ six (6) months after the effective date of this sec-tion: a. Procedures for the issuance and annual renewal of qualifying patient identification cards to people

with physidan certifications and standards for renewal of such identifica-tion cards. Before issuing an identification card to a minor, the Department must re-ceive written consent from the minors parent or legal guardian, in addition to the physidan certification. b. Procedures establishing qualifications and standards for caregivers, induding con-ducting appropriate background checks, and procedures for the issuance and annual re-newal of caregiver identification cards. c. Procedures for the registration of MMTCs that indude procedures for the issuance, re-newal, suspension and revocation of regis-tration, and standards to ensure proper se-curity, record keeping, testing, labeling, in-spection, and safety. d. A regulation that defines the amount of marijuana that could reasonably be pre-sumed to be an adequate supply for qualify-ing patients medical use, based on the best available evidence. This presumption as to quantify may be overcome with evidence o1 a particular qualifying patients appropriate medical use. (2) Identification cards and registrations. The Department shall begin issuing qualify-ing patient and car^iver identification cards, and registering MMTCs no later than nine (9) months after tie effective date of this sec-tion. (3) If the Department does not issue regula-tions, or if the Department does not begin is-suing identification cards and registering MMTCs within the time limits set in this sec-tion, any Florida dtizen shall have standing to seek iudidal relief to compel compliance with the Departments constitutional duties. (4) The Department shall protect the confi-dentialify of all qualifying patients. All records containing the identify of qualifying patients shall be confidential and kept from public dis-dosure other than for valid medical or law enforcement purposes. (e) LEGISLATION. Nothing in this section shall limit the legislature from enacting laws consistent with this section. self-executing and does not require implementing legislation. (f) By general law and subject to conditions and limirations spedfied therein, the Legisla-ture may provide ad valorem tax relief equal to the total amount or a portion of the ad val-orem tax othenivise owed on homestead properfy to: (1) The surviving spouse of a veteran who died from service-connected causes while on active dufy as a member of the United States Armed Forces. (2) The surviving spouse of a first responder who died in the line of dufy. (3) A first responder who is fotelly and per-manently disabled as a result of an injury or injuries sustained in the line of dufy. Causal connection between a disabilify and service in the line of dufy shall not be presumed but must be determined as provided by general law. For purposes of this paragraph, the term "disabilify' does not indude a chronic condi-tion or chronic disease, unless the injury sus-tained in the line of dufy was the sole cause of the chronic condition or chronic disease. As used in this subsection and as further de-fined by general law, the term "first respon-der" means a law enforcement officer, a cor-rectional officer, a firefighter, an emergency medical technidan, or a paramedic^ and the term "in the line of duty" means arising out of and in the actual perfonnance of dufy re-quired by employment as a first responder. Para permitir al Departamento tiempo sufidente despu^s de la aprobaddn de esta secd6n, las sigu-lentes reguladones se promulgardn a mds tardar seis (6) meses despu^s de la fecha de vigenda de esta secdfin: a. Procedimien-tos para la emisi6n y renovad6n anual de tarjetes de identificaci6n de padentes califi-cados para personas con certificadones m^dicas y estandares para la renovaddn de dichas tarjetas de identificad6n. Antes de emitir una tarjeta de identificad6n a un menor, el Departamento debe redbir el con-sentimiento por escrito de uno de los padres 0 tutor legal del menor, ademSs de la certifi-cad6n m^dica. b. Procedimientos que

es-tablecen calificadones y estandares para los cuidadores, induida la realizaddn de verifi-cadones de antecedentes apropiadas, y procedimientos para la emisifin y renovadfin anual de taijetas de identificad6n de cuidadores. c. Procedimientos para el reg-istro de MMTC que induyen procedimientos para la emisi6n, renovaddn, suspensi6n y revocad6n del registro, y estandares para garantizar la seguridad, el mantenimiento de registros, las pmebas, el etiquetado, la in-specd6n y la seguridad adecuados. d. Una regulad6n que define la cantidad de mari-huana que razonablemente podrfa pre-sumirse como un suministro adecuado para el uso medico de los padentes calificados, basdndose en la mejor evidenda disponible. Esta presundfin de cantidad puede super-arse con evidenda del uso medico apropia-do de un padente en particular que califica. (2) Taijetes de identificad6n y registros. El Departamento comenzard a emitir tarietas de identificad6n de padentes y cuidadores calificados y a registrar los MMTC a mSs tar-dar nueve (9) meses despu^s de la fecha de entrada en vigor de esta secd6n. (3) Si el Departamento no emite regula-dones, 0 si el Departamento no comienza a emitir tarjetas de identificad6n y a registrar MMTC dentro de los llmltes de tiempo es-tableddos en esta secd6n, cualquier du-dadano de Florida tendrd Iegitimad6n active para buscar reparad6n iudidal para obligar al cumplimiento de las disposidones consti-tudonales del Departamento. (4) El Departamento protegerS la confiden-cialidad de todos los pacientes que cali-fiquen. tiple u otras afecdones mbdicas debilitantes del mismo tipo 0 dase o comparables a las enu-meradas, y para las cuales un medico cree que el uso medico de la marihuana proba-blemente superaria los riesgos potendales para la salud del padente. (2) Departamento significa el Departamento de Salud o su agenda sucesora. (3) Tarjeta de identificad6n significa un doc-umento emitido por el Departamento que identifica a un padente o cuidador calificado. (4) Marihuana tiene el significado que se le atribuye al cannabis en la Secdbn 893.02 (3) de los Estatutos de Florida (2014) y, ademds, cannabis con bajo contenido de THC tal como se define en la Secdbn 381.986 1) (b) de los Estatutos de Florida (2014), iambiSn se induirS en el significado del tSnri no marihuana. (5) Centro de Tratemiento de Marihuana Medldnal (MMTC) significa una entidad que adquiere, cultiva, posee, procesa (induido el desarrollo de productos reladonados como alimentos, tinturas, aerosoles, aceites o unguentos), transfiere, transporta, vende, di^ribuye, dispensa o suminisfra marihuana, productos que contienen marihuana, sumin-istros relacionados o materiales educatlvos a padentes calificados o sus cuidadores y esta registrado por el Departamento. (6) Uso medldnal significa la adquisid6n, posesibn, uso, entrega, transferencia o ad-ministraci6n de una cantidad de marihuana que no entre en conflicto con las reglas del Departamento, o de suministros reladona-dos por parte de un padente o cuidador cali-ficado para uso de la persona calificada des-ignada por el cuidador del padente para el tratamiento de una enfermedad m^dica de-bllltante. (7) Cuidador significa una persona que tiene al menos veintiun (21) alios de edad que ha aceptado de ayudar con el uso medldnal de marihuana de un padente calificado y ha calificado y obtenido una tarjeta de identifh cad6n de cuidador emitida por el Departa-mento. El Departamento puede limitar la cantidad de padentes calificados que un cuidador puede ayudar al mismo tiempo y la cantidad de cuidadores que un padente cali-ficado puede tener al mismo tiempo. Los cuidadores tienen prohibido consumir mari-huana obtenida para uso medico por el pa-dente calificado. (8) Medico significa una persona que tiene llcenda para ejercer la medidna en Florida. (9) 'Certificaddn del medico' significa un documento escrito firmado por un medico, que establece que, en la opini6n profesional del medico, el paciente sufre de una condi-d6n m6dica debllltante, que el uso medico de la marihuana probablemente superan'a los riesgos potendales para la salud del pa-dente. y durante cu4nto tiempo el medico recomienda el uso medico de la marihuana al padente. S6lo se puede propordonar una certificad6n m6dica despu^s de que el medico haya realizado un examen fisico y una evaluad6n completa del historial medico del padente. Para que se emita una certifi-cad6n m6dica a un menor, unos de los padres, o tutor legal del menor debe dar su consentimiento por escrito. (10) Padente calificado significa una per-sona a la que se le ha diagnosticado una condid6n m^dica debllltante, que tiene una certificadbn mSdica y una terjete de identifi-cad6n de padente calificado vdlida. Resumen de ia Iwieta Se propone una enmienda a la Constitud6n del Estado para exigir un ajuste anual por in-flad6n al valor de las exendones de propiedad actuates o futuras que se aplican unicamente a gravSmenes distintos de los impuestos del distrito escolar y para los cuales toda persona que tenga un titulo le-gal 0 equitetivo sobre bienes inmuebles y los mantenga es elegible la residenda perma-nente del propieterio, o de otra persona que dependa legal o naturalmente del propi-eterio. Esta enmienda entra en vigenda el 1 deenerode2025. Texto ARTlCULO VII ^ FiNANZAS Y TRIBUTACidN SECCI6N 6. Exendones Impositivas para viviendas famlllares. (a) (llToda persona que tenga titulo legal o equllatlvo sobre bienes ralces y los manten-ga como residenda permanente del propl-etario, u otra persona que dependa legal o naturalmente del propletario, estar^ exenta de tributaddn sobre los mismos, excepto las evaluadones por benefldos espedales, como slflue.^ ^^^^ ^^^ ^^ velntldnco mil permitird mds de una exencl6n a ninguna persona o unldad familiar respec-to a ninguna unldad residendal. (c) De conformidad con la ley general y con sujed6n a las condldones que se especlfl-can en la misma, la Legislatura podrd entre-garies a los arrendatarios que sean resi-dentes permanentes una desgravadbn fiscal ad valorem sobre todos los gravdmenes fls-cales ad valorem. DIcha desgravad6n fiscal ad valorem se establecerS de la fbnria y en el monto que disponga la ley general. (d) La Legislatura podrd, de conformidad con la ley general, pennltirles a los conda-dos o munlclplos, para efectos de sus gravSmenes fiscales respectlvos y con suje-d6n a las disposidones de la ley general, conceder cualqulera de las sigulentes exen-dones impositivas adidonales para vivien-das famlllares o ambas: (1) Una exencl6n que no supere cincuenta mil d6lares para una persona que tenga la titularidad legal o en equldad sobre b^nes raices y mantenga alii la residenda perma-nente del propieterio, que haya cumplldo la edad de sesenta y dnco anos, y cuyos In-gresos famlllares, segi^n lo define la ley gen-eral, no superen velntldnco mil d6lares; o (2) Una exend6n equlvalente al valor tasa-do del Inmueble para una persona que tenga titularidad legal o equltatlva sobre los bienes raices con un valor justo Infer or a dosclen-tos dncuenta mil dAlares, segi^n se deter-mine en el primer ejerddo fiscal que apllque el propletario y que cumpla los requisites para la exendAn, y que haya mantenldo en los mismo

La ley general debe permltlries a los conda-dos y munldplos conceder dichas exen-dones adidonales, dentro de los limites que se prescriben en este Indso, medlante una ordenanza que se adopte de la manera que lo prescribe la ley general, y debe disponer el ajuste peri6dlco de la Ilmited6n sobre In-gresos que se prescribe en este Indso re-specto a los camblos en el costo de vida. (e) (1) Cada veterano que tenga 65 anos o mds y que sufra una discapacidad parclal o total recibird un descuento del monto del Im-puesto ad valorem que se adeude sobre la vivlenda familiar que posea el veterano y donde el mismo reslda si la discapacidad hublera sido causada por el combate y el veterano hublera sido dado de baja con hon-or tras retirarse del servido milifar. El des-cuento se expresarS en un porcenteje equlv-alente al porcentaje de la discapacidad per-manente vinculada al servido del veterano, segin lo determine el Departamento de Asuntos de los Veteranos de los Estados Unldos. Para optar al descuento que se con-cede en este apartado, el sollcltante debe presentarie al tasador inmoblllarlo del con-dado a mds tardar el 1 de marzo, una carta oflclal del Departamento de Asuntos de los Veteranos de los Estados Unldos medlante la que se Indlque el porcentaje de la dis-capacidad vinculada al servido del veterano y las pruebas que demuestren de manera razonable que la discapaddad fue causada por el combate, asi como tambl^n una copla de la baja con honor del veterano. SI el tasador Inmoblllario rechaza la sollcltud de descuento, el tasador debe notlficarle al so-llcltente por escrito los motives del rechazo, y el veterano podr4 volver a reallzar la sollcl-tud. La Legislatura podrd, de conformidad con la ley general, deslstir del requerimiento anual de solicitudes en los anos posteriores. (2) SI un veterano que redbe el descuento descrito en el apartado (1) fallece antes de su c6nyuge, ysi, al fallecer el veterano, el (la) c6nyuge sobrevlvlente posee la titulari-dad legal o el usufmcto de la vivlenda famil-iar y reside permanentemente alii, el des-cuento se transfiere al (la) c6nyuge sobre-vlvlente haste que se vuelva a casar, venda o de otra manera disponga de la vivlenda fa-miliar. SI el (la) c6nyuge sobrevlvlente ve nde o de otra manera dispone de la vivlenda, se podrd transferir a la nueva vivlenda familiar del (la) aSnyuge sobrevlvlente un descuento que no excecte el monto en d6lares otorgado segun el registro fiscal ad valorem mds re-dente, si la utiliza como su residenda per-manente y si no se ha vuelto a casar. (3) Este indso tiene efedo inmediato y no necesita Iegislad6n de implementad6n. (f) De conformidad con la ley general y con sujed6n a las condldonesy limitedones que se especifican en la misma. La Legislatura podrd concederie una desgravad6n fiscal ad valorem equlvalente al monto total o una parte del impuesto ad valorem que se adeude sobre la vivlenda familiar a: (1) El (la) aSnyuge sobrevlvlente de un vet-erano que haya falleddo durante su servido adivo en calidad de miembro de las Fuerzas Armadas de los Estados Unldos. (2) El (la) cbnyuge sobreviviente de un so-corrista que haya falleddo en acto de servi-do. (3) Un socorrista que tenga una discapaci-dad totaly permanente a

causa de una Iesi6n 0 lesiones que haya sufrido en acto de servido. La conexi6n causal entre una discapaddad y el acto de servido no debe presumirse, sino que determinarse segun lo dispone la ley general. Para efectos de este apartado, el fermino discapaddad no Induye una afeccl6n cr6nlca o enfermedad cr6nlca, a menos que la Iesl6n que se haya sufrido en acto de servido hublera sido la i^nlca causa de la afeccl6n cr6nlca y la enfer-medad cr6nlca. SegOn se usa en este Indso y segOn lo defi-na m^ extensamente la ley general, el t6r-mlno socorrista hace referenda a un policia, un fundonario penltenclario, un bombero, un t^cnlco medico de emergencia o un paramSdIco, y el tSrmIno en acto de servido significa que surge a raiz del desempefio real del servido que sea necesario en virtud del trabajo como socorrista.
