Man charged with murdering father: Brooks accused of killing father to collect $500,000 life insurance policy

March 20--After several rounds of investigation, 30-year-old James Kyle Brooks has been charged with murder in the first degree with deliberate intent for allegedly killing his father, Timothy James Brooks, after taking out a $500,000 life insurance policy on him.

The Oklahoma State Bureau of Investigation was assigned to investigate the death of Brooks' father back in November of 2016 and talked with Marlow Police about the murder.

At approximately 11:26 a.m. Aug. 8, 2012, James allegedly called 911 to report his father had shot himself. Marlow Police responded to the scene.

Upon reaching the residence, James was allegedly waiting at the door. A Marlow officer walked inside the house and observed a man with a 12-gauge shotgun between his legs pointing toward the ceiling.

During the interview, James told the investigators that his father was sitting in the living room cleaning a shotgun and allegedly was talking crazy when James said he was tired of hearing the "crazy" talk.

Telling investigators that the man lifted the gun up at an angle, James told investigators that the father threatened to shoot himself.

James said his father allegedly shot himself in the abdomen, withJames going over to check for a pulse while giving him two breaths of air, then calling 911.

During the interview, police asked James if his father had a life insurance policy which Brooks allegedly said yes and told him it was either a $250,000 or a $500,000 policy and was unsure of which.

In December of 2016, OSBI obtained a search warrant for all the life insurance records pertaining to the policy. An agent noticed that James was the sole beneficiary. James had told police he was a joint beneficiary with his sister.

OSBI noticed that James was the only one paying the premiums each month and he waited a full year to file a claim with the insurance company.

James allegedly was also continuing to pay the premium on the father's policy for almost 10 months after the father's death, according to the affidavit.

OSBI and the Stephen's County District Attorney's office, after meeting with the state medical examiner, learned it was highly unlikely the father shot himself with the shotgun.

After completing their investigation, OSBI believed James took out the policy and shot and killed his father with the shotgun, staging the scene to make it look like a suicide.

The charges were brought against James Friday afternoon at Stephens County Courthouse and, according to the Stephens County District Attorney's office, the warrant has been returned for his arrest, indicating James is in police custody.

James hasn't made a formal appearance in front of a Stephens County judge, when his bond will be set.
