DA Jim Martin settles defamation lawsuit against Lehigh Valley blogger who accused him of fixing cases [The Morning Call]

The settlement comes about a month after Erie Insurance Exchange filed a petition to intervene in the case, noting that Villa’s homeowner’s insurance precludes coverage for suits for libel, slander or defamation of character if the statement was knowingly untrue.

“Jim Martin arranged, in secret, a bargained plea deal with Sheena’s killer and his family. He scheduled a court date, you know, to make it official, and then he never notified our family about it. We weren’t invited to the guilty plea hearing.”
In a motion to throw out the suit before trial, Villa’s lawyer argued the statements were protected because they were opinions based in fact, that Martin could not prove they were false or that Villa knew they were false and Martin had not presented any evidence that he was harmed.

Tests showed that LaBarre’s blood-alcohol level at the time of the crash was .24 — three times the legal limit. Police also found that he was driving 85 mph. He pleaded guilty to vehicular homicide in 2007 and was sentenced to 5½ to 12 years in state prison.
