PRC Insurance Division Going After Shady Roofing Companies

SANTA FE, N.M., Feb. 20 -- The New Mexico Public Regulation Commission issued the following news release:

After receiving numerous complaints from consumers and insurance companies, the Public Regulation Commission's (PRC) Division of Insurance (DOI) is warning the public about several roofing companies operating in the state as "public adjusters" without required licenses.

DOI staff reports indicate the businesses in question are entering into contracts with homeowners to negotiate and handle damage claims without legal authority, which can eventually result in an increase to premiums once the property owner's insurer finds out about it.

The DOI announced Monday it has taken enforcement action against some of the companies involved, and actions are already pending in several cases. The division also said it has alerted the Office of the Attorney General and the state's Construction Industries Division.

When a house is damaged, the DOI recommends homeowners contact their insurance agent or company directly to process the claim, and avoid services offered from contractors that seem too good to be true.

"It is one of our primary responsibilities to protect and educate the insurance consumers in New Mexico from unethical practices of individuals or companies and we will take the appropriate actions to ensure that the insurance consumer is protected and not subject to undue fees, charges or premiums," said state Superintendent of Insurance, John Franchini.

Franchini added that the DOI will continue to monitor the situation and take any and all actions against anyone or any company who is in violation of the New Mexico Insurance Code.
