Co announces that its board of directors has approved a new stock repurchase program to acquire up to $400 mln of co's common stock through the end of 2011. The program increases co's combined repurchase authorizations to ~$2.0 bln, of which ~$1.6 bln has been used to purchase ~31 mln shares, representing 38% of co's fully diluted shares outstanding when this program began in 2008. GYRO Gyrodyne of America announces State of New York Files notice of appeal in condemnation case (79.90 -1.40)
Co announced that the State of New York on September 7, 2010 filed a Notice of Appeal to the Appellate Division of the Supreme Court, Second Department, from the judgment of the Court of Claims entered in favor of Gyrodyne for $125 million plus statutory interest through the date of payment. Under the Rules of Procedure of the Appellate Division, Second Department, an appellant is allowed up to 6 months from the date of its notice of appeal to perfect the appeal and file its brief. Gyrodyne brought this claim in April 2006 for just compensation for the 245.5 acres of its Flowerfield property in St. James and Stony Brook, New York, taken by the State. The State had paid Gyrodyne $26,315,000 for the Property at the time of the taking, which Gyrodyne elected, under the eminent domain law, to treat as an advance payment while it pursued its claim. Gyrodyne has submitted an application to the Court of Claims seeking reimbursement of attorneys' fees and costs in the amount of $1,474,191.18. The amount of a final award and the timing of payment are still unknown at this time. Gyrodyne intends to continue pursuing its rights vigorously, seeking payment in accordance with the Court's judgment and any further determinations. (Note that the stock surged 24 points higher on Aug 1 after the co confirmed that the court of claims issued favorable opinion in condemnation litigation)

co announces Phase II clinical trial results showing that its investigational fixed-dose, single-tablet "Quad" regimen of elvitegravir, cobicistat and Truvada for the treatment of HIV infection maintained a high rate of virologic suppression through 48 weeks, exhibiting antiretroviral activity comparable to that of Atripla. At week 48, the proportion of patients who achieved HIV RNA less than 50 copies/mL was 90% in the Quad arm and 83% in the Atripla arm. Results from a separate study also being presented by Dr. Elion at ICAAC show that cobicistat-boosted atazanavir plus Truvada has similar efficacy and safety to ritonavir-boosted atazanavir plus Truvada at 48 weeks. Changes to estimated glomerular filtration rates observed among patients early in the study remained stable through week 48 and were comparable to the changes observed among patients receiving ritonavir.

Co presented preclinical findings for its humanized monoclonal antibodies against the disease-causing toxins produced by the bacterium Clostridium difficile (C. difficile). In a well-established hamster model of C. difficile-associated disease (CDAD), treatment with Progenics' antitoxin antibodies resulted in 95% survival versus 0% survival for standard antibiotic treatment. Nineteen of twenty (95%) animals treated with antibodies survived until the end of the 40-day study. In contrast, none of the eight vancomycin-treated animals survived more than 22 days, and none of the eight control (untreated) animals survived more than three days. The survival advantage provided by antibody treatment was highly statistically significant (P<0.0001) relative to both the vancomycin and control groups.

Black Oak will produce high-quality metallurgical coal with expected annual volume of around 500K tons, reaching full production in the second half of 2011. Additionally, the planned longwall move at the Panther mine is underway, with production expected to resume later this month. Separately, as a result of the recent judgment received by two Patriot subsidiaries with respect to pending selenium lawsuits, the Company expects to record a non-cash charge that will negatively impact net income. Patriot does not expect the charge to impact EBITDA, based on its non-cash nature.
