American Property Casualty Insurance Association: Indiana Enacts Several Bills That Provide Consumer Protections

INDIANPOLIS, Indiana, May 9 (TNSgov) -- The American Property Casualty Insurance Association issued the following news release:

This legislative session Indiana Governor, Eric Holcomb, has signed three bills (HB 1124, HB 1125, and HB 1329) all sponsored by Rep. Matt Lehman that protect consumers. The governor signed HB 1125, which addresses delivery network companies and HB 1329, which involves data transparency and allows an insured to void or rescind a contract with a public adjuster. Earlier this session the governor signed HB 1124, which addressed third party litigation funding. "The Legislature and Gov. Holcomb's actions keep Indiana moving in a positive direction by striking the right balance of consumer protections with making informed insurance decisions while protecting the proprietary information of an insurer," according to Brooke Kelley, assistant vice president, state government relations for the American Property Casualty Insurance Association (APCIA).

HB 1125, which was signed Friday, establishes workable insurance requirements for delivery network companies (DNC's) that allow people to use their personal vehicle to make deliveries for companies such as Grubhub, Drizly, and Doordash. The bill was based on the NCOIL model passed in 2022. Its framework is similar to the one for Transportation Network Companies (TNC) and helps to close potential insurance gaps for deliveries.

House Bill 1329, also signed Friday, is designed to provide greater data transparency for personal line policies, and it cracks down on bad acting public adjusters. "The insurance industry commends Rep. Lehman for his actions and is supportive of transparency efforts that enhance consumer understanding of auto and home insurance pricing," said Kelley.

Signed earlier this year, HB 1124, requires that third party litigation funding agreements be disclosed during civil proceedings. APCIA is working around the country to encourage federal courts and states to adopt common sense reforms that require those involved in litigation to disclose the presence and financial interest of outside parties, such as litigation funders.
