BRIEF: Erie inmate lawsuit settled for $65K

Nov. 17--Erie County's insurer has agreed to pay $65,000 to settle a former Erie County Prison inmate's claims that he was assaulted by a corrections officer and left brain-damaged.

With the settlement to be paid to Jerome McCallion and his lawyer, John Mizner, Erie County and the corrections officer named in the lawsuit, Brian Ames, admit no wrongdoing.

"The parties to this matter have considered the risk and expense associated with having the merits of this case decided at trial, and because of that risk and expense, the parties have instead amicably settled the claims raised in this matter," the two sides said in a joint statement to the Erie Times-News.

"Pursuant to that settlement, the insurance risk pool for the County of Erie has agreed to pay Mr. McCallion the sum of $65,000.00 and in exchange, Mr. McCallion has agreed to terminate his lawsuit, with prejudice, and release Brian Ames from all claims that have been raised. The settlement of this matter was accomplished without any finding or admission of wrongdoing on the part of Brian Ames or the County of Erie."
