VITALE BILL TO STRENGTHEN NEW JERSEY IMMUNIZATION POLICY AND COVERAGE HEADS TO GOVERNOR'S DESK

The following information was released by the New Jersey State Senate, Democrats :

Legislation sponsored by Senator Joe Vitale to update and strengthen New Jersey's immunization laws has passed both houses of the Legislature and now heads to the Governor's desk.

The bill, S-4894, updates statutory and regulatory references so that New Jersey's immunization standards are anchored in recommendations issued by the New Jersey Department of Health. Under the legislation, the Department will serve as the state's primary recommender while considering guidance from the Advisory Committee on Immunization Practices of the Centers for Disease Control and Prevention, as well as recommendations from leading medical organizations including the American Academy of Pediatrics, the American Academy of Family Physicians, the American College of Obstetricians and Gynecologists, and the American College of Physicians. All state agencies would be required to align their rules and regulations with the Department of Health's immunization guidance.

"New Jersey families and health care providers rely on consistent, evidence-based vaccine guidance," said Senator Vitale (D-Middlesex). "This legislation ensures our standards remain rooted in medical expertise, even as federal policy becomes less predictable. Recent actions, including the federal move to weaken longstanding Hepatitis B vaccine guidance, show how quickly national recommendations can shift without clear evidence or clinical consensus. New Jersey should not be dependent on abrupt changes that could undermine confidence in immunizations. By empowering the Department of Health to consider the full spectrum of expert recommendations, we are building a more resilient and dependable vaccine policy for our state."

The legislation also requires health insurers and the state Medicaid Program to cover immunizations with no cost-sharing when those immunizations are recommended by the New Jersey Department of Health. In making these determinations, the Department must consider guidance from ACIP and the major medical organizations specified in the bill, ensuring that coverage decisions reflect the best available clinical expertise.

States including California, Colorado, Maine, Maryland, and Washington, D.C., have already moved toward independent or supplemental vaccine guidance. More than twenty states now rely on nonfederal entities for some portion of their immunization recommendations.
