Settlement reached between prosecutor, Boone Co. Commission and terminated employee

MADISON - In documents obtained via a Freedom of Information Act request for Boone County public records, a financial settlement was reached on Oct. 1 between Boone County Prosecutor Donna Taylor, the Boone County Commission, West Virginia Counties Group Self-Insurance Risk Pool, Inc., and terminated Assistant Prosecutor Timothy P. Gibson Jr. regarding alleged acts that occurred on or before March 5, 2021.

Gibson is referred to as the "releasing party" in the documents for the consideration of $70,000 and disbursed to the following:

Timothy P. Gibson, Jr. - $31,111.13Boone County Commission - $15,555.54 (reimbursement wages)Hatfield & Hatfield, PLLC - $23,333.33 (attorney fees)

In part, according to the release, Gibson will "release and forever discharge Donna Taylor, the Boone County Commission and the Boone County Prosecuting Attorney's office and the (financial settlement source) West Virginia Counties Group Self-Insurance Risk Pool, Inc. d/b/a WV Communities Risk Pool (WVCORP) ("Released Parties") and their successors, agents, employees, heirs, personal representatives and assigns, of and from all claims, demands, damages, actions, causes of action, and suits at law, past, present and future, both known and unknown, of whatever kind of nature, for or because of or arising out of any way my employment with the Boone County Prosecuting Attorney or Boone County Commission including my termination and events leading up to my termination and including those certain alleged acts alleged on or before March 5, 2021, including any whistleblower award of sanctions."

According to Boone County records, Gibson's annual salary was $68,500 at the time of his termination as assistant prosecutor.
