Rosenfeld Meyer & Susman Secures $2 Million Jury Verdict for Doublevision Entertainment, LLC

LOS ANGELES, July 23, 2015 /PRNewswire/ -- Entertainment law firm Rosenfeld Meyer & Susman LLP today announced that it has obtained a $2,280,000.00 jury verdict before the Honorable William Alsup in the U.S. District Court for the Northern District of California on behalf of its client Doublevision Entertainment, LLC in an insurance bad faith case alleging breaches of the duties to settle, to pursue settlement and to defend by a large errors and omissions insurance provider.  With this verdict, lead counsel Ryan M. Lapine remains undefeated at trial.

"This was a very complex case, alleging misconduct by a large insurer that put on a strong defense," said trial attorney Ryan M. Lapine. "In the end, we were able to obtain a directed verdict from the Court on our third cause of action and a unanimous jury verdict in our favor in under three hours on our other two causes of action.  The insurer argued for an offset.  The jury denied that request."

The case stems from Doublevision Entertainment, LLC's failed escrow transaction with Commercial Escrow Services, Inc. (CES).   In 2013, Rosenfeld Meyer & Susman LLP successfully obtained a $1,500,000 jury verdict plus interest and costs for Doublevision Entertainment in a lawsuit against CES regarding the propriety of that escrow transaction.  Early in that case, Doublevision Entertainment made an offer to settle for $245,000 that was not accepted.  Later, CES's insurer filed an interpleader action, pulling CES's defense in Doublevision Entertainment's suit against it.   Doublevision Entertainment, on assignment from CES, sued that insurer, alleging that it breached its duties by failing to accept the $245,000 settlement offer, by failing to reasonably pursue settlement once liability became clear, and by failing to defend CES due to its improper interpleader.
