NOTICE OF PUBLIC HEARINGS NOTICE IS HEREBY GIVEN that the Ponderay City Council will hold a public hearing on Wednesday, July 5, 2023 at 5:30 p.m., to consider the following request: File UP23-098, Walmart Real Estate Business Trust, Special Use Permit, Retail Space over 20,000 sq ft: Wal-Mart is requesting special use permit approval in order to bring a legal non-confirming or "grandfathered" use into compliance with current land use regulations and allow for expansion. Ponderay City Code 9-4C-4, Commercial Zone, Special Uses, allows wholesale and retail facilities in excess of 20,000 sq feet by special use permit. At this time, Walmart wishes to increase the footprint of the current structure in order to add ±1,488 (previously identified as ±1,128) square feet at the northeast corner to better accommodate online pick up orders which causes an increase in the non-conformity. Additionally, the modified site plan proposes construction of a new generator pad at the rear of the facility. The site is located on the southeast corner of Highway 95 and Kootenai Cutoff Road in Section 11, Township 57 North, Range 2 West, Boise Meridian. The Ponderay Planning Commission recommended approval of this application to the City Council at its regularly scheduled meeting on June 8, 2023.
