Beneficiary has elected, and has directed the Trustee to sell the above described property to satisfy the obligation. The sale is a public sale and any person, including the Beneficiary, excepting only the Trustee, may bid at the sale. The bid price must be paid immediately upon the close of bidding in cash or cash equivalents (valid money orders, certified checks or cashier's checks). The conveyance will be made by Trustee's Deed, without any representation or warranty, including warranty of title, express or implied, as the sale is made strictly on an as-is, where-is basis, without limitation, the sale is being made subject to all existing conditions, if any, of lead paint, mold or other environmental or health hazards. The sale purchaser shall be entitled to possession of the property on the 10th day following the sale. The Grantor, successor in interest to the Grantor, or any other person having an interest in the property, has the right, at any time prior to the Trustee's Sale, to pay to the Beneficiary, or the successor in interest to the Beneficiary, the entire amount then due under the Deed of Trust and the obligation secured thereby (including costs and expenses actually incurred and attorney's fees) other than such portion of the principal as would not then be due had no default occurred and by curing any other default complained of herein that is capable of being cured by tendering the performance required under the obligation or to cure the default, by paying all costs and expenses actually incurred in enforcing the obligation and Deed of Trust with Successor Trustee's and attorney's fees. In the event that all defaults are cured the foreclosure will be dismissed and the foreclosure sale will be canceled. The scheduled Trustee's Sale may be postponed by public proclamation up to 15 days for any reason. In the event of a bankruptcy filing, the sale may be postponed by the Trustee for up to 120 days by public proclamation at least every 30 days. NOTICE OF FINDING OF NO SIGNFICANT IMPACT AND NOTICE OF INTENT TO REQUEST RELEASE OF FUNDS January 23, 2025 City of Troy 301 E. Kootenai Avenue Troy, Montana 59935 406-295-4151 These notices shall satisfy two separate but related procedural requirements for activities to be undertaken by the City of Troy. REQUEST FOR RELEASE OF FUNDS On or about February 11, 2025 the City of Troy will submit a request to the Montana Department of Commerce for the release of Community Development Block Grant funds under Title I of the Housing and Community Development Act of 1974, as amended (PL 93-383), to undertake a project known as the Troy Water System Improvements Project for the purpose of improvements to the City of Troy's Water System. Improvements include the replacement of water mains and the installation of a flow meter on a hydrant at the County Shop. FINDING OF NO SIGNIFICANT IMPACT The City of Troy has determined that the project will have no significant impact on the human environment. Therefore, an Environmental Impact Statement under the National Environmental Policy Act of 1969 (NEPA) is not required. Additional project information is contained in the Environmental Review Record (ERR) on file at the City of Troy, 301 E. Kootenai Avenue, Troy, Montana 59935 and Robert Peccia and Associates, P.O. Box 5653, Helena, Montana 59604 and may be examined or copied at either location, weekdays 9 A.M to 4 P.M. PUBLIC COMMENTS Any individual, group, or agency may submit written comments on the ERR to the City of Troy. All comments received by February 10, 2025 will be considered by the City of Troy prior to authorizing submission of a request for release of funds. Comments should specify which Notice they are addressing. ENVIRONMENTAL CERTIFICATION The City of Troy certifies to the Montana Department of Commerce that Tyler Boswell in his capacity as Mayor consents to accept the jurisdiction of the Federal Courts if an action is brought to enforce responsibilities in relation to the environmental review process and that these responsibilities have been satisfied. The Montana Department of Commerce's approval of the certification satisfies its responsibilities under NEPA and related laws and authorities and allows the City of Troy to use Program funds. OBJECTIONS TO RELEASE OF FUNDS Montana Department of Commerce will accept objections to its release of funds and the City of Troy's certification for a period of fifteen days following the anticipated submission date or its actual receipt of the request (whichever is later) only if they are on one of the following bases: (a) the certification was not executed by the Certifying Officer of the City of Troy; (b) the City of Troy has omitted a step or failed to make a decision or finding required by HUD regulations at 24 CFR part 58; (c) the grant recipient or other participants in the development process have committed funds, incurred costs or undertaken activities not authorized by 24 CFR Part 58 before approval of a release of funds by the Montana Department of Commerce; or (d) another Federal agency acting pursuant to 40 CFR Part 1504 has submitted a written finding that the project is unsatisfactory from the standpoint of environmental quality. Objections must be prepared and submitted in accordance with the required procedures (24 CFR Part 58, Sec. 58.76) and shall be addressed to Montana Department of Commerce, Community Development Division at 301 S.
