Driver in fatal hit-and-run begins weekends in jail
Buffalo News (NY)
Jun. 28--Anthony J. DiFilippo of Wheatfield, whose sport utility vehicle struck and killed a teenage pedestrian in 2014, will begin serving a year of weekends in jail Friday night.
State Supreme Court Justice Richard C. Kloch Sr. imposed the predetermined sentence Thursday. The sentence is for insurance fraud, not leaving the scene of a fatal accident.
DiFilippo, 44, admitted in January that he padded his claim for damages to the SUV after the boy's mother rammed her car into DiFilippo's garage door in 2017. The mother, Lisa Fischer, pleaded guilty to misdemeanor driving while intoxicated.
Her son Ryan Fischer, 16, was struck from behind on Krueger Road in WheatfieldNov. 20, 2014.
DiFilippo was arrested in September 2015, pleaded guilty to leaving the scene and was placed on probation, which he violated by committing insurance fraud.
If DiFilippo pays $11,340 in restitution, fines and fees in the next year, he will serve another six months in jail for the probation violation. If not, he could serve four years.
