Congressional Western Caucus: Chairman Newhouse's Statement on the Supreme Court's WOTUS Ruling

WASHINGTON, May 26 (Rep.) -- The Congressional Western Caucus issued the following news release on May 25, 2023:

Chairman Dan Newhouse (WA-04) released the following statement in response to the U.S. Supreme Court's decision in the case, Sackett v. EPA, which ruled in favor of the Sacketts.

"Today's ruling by the Supreme Court is a win for rural America. For too long, the federal government has used WOTUS as a way to put every ditch, stream, and puddle under its purview, eroding the private property rights of Americans and threatening the long-term viability of agriculture and industry in America," said Chairman Dan Newhouse (WA-04). "In a unanimous decision, the courts ruled in favor of the Constitution, the American people, and our freedoms. Now, I call on the Biden Administration to do its part and immediately rescind its rule which would so clearly be considered unconstitutional by the highest court in the land."

Background:

The Congressional Western Caucus has long been active in fighting against the burdensome WOTUS ruling, their actions include:

* On January 26, 2023 Chairman Newhouse sent a letter (https://westerncaucus.house.gov/news/documentsingle.aspx?DocumentID=4151), along with 195 House Republicans--including the entire Western Caucus, to the Biden Administration urging them to rescind their premature and reckless rule.

* On December 30, 2022, Chairman Newhouse and 22 Members of the Congressional Western Caucus spoke out against the Biden Administration releasing a final WOTUS rule--on the last business day of the year--before the Supreme Court has decided Sackett v. EPA.

* In April 2022, Chairman Newhouse, Rep. Miller-Meeks, and Rep. Rodney Davis (IL-13) submitted an amicus brief (https://westerncaucus.house.gov/news/documentsingle.aspx?DocumentID=3960) to the Supreme Court for Sackett v. EPA outlining the importance of environmental federalism and how a poorly-defined Clean Water Act hinders environmental protections.

* On March 9, 2022, Chairman Newhouse, Transportation and Infrastructure Ranking Member Sam Graves (MO-06), and Water Resources and Environment Subcommittee Ranking Member David Rouzer (NC-07) led over 200 House Republicans - including every Member of the Western Caucus - in calling for the Biden Administration to drop its plan to expand the scope of "waters of the United States" (WOTUS) until Sackett v. * In January 2022, Chairman Newhouse and Rep. Miller-Meeks called on the Administration to halt the rulemaking process, based on the Supreme Court's decision to take up the Sackett case.
