Commissioners forward tort claim about hot playground equipment to insurer

Morgan County may end up paying damages after a juvenile reportedly suffered burns on hot playground equipment in Mooresville.
The board of commissioners moved Monday to send the tort claim to the county's insurance company.
The claim is the first step in the legal process to notify a government entity before the filing of a lawsuit. The claim gives the government time to research it and possibly make an offer to avoid going to court.

In this case, the claim from Hurst Limontes LLC, alleged that on Aug, 5, 2022, a juvenile was playing on monkey bars at Waverly Elementary School when the juvenile burned his hands on the hot metal.
The claim states the juvenile suffered "burns, pain, suffering, and infection to both hands." The parent of the juvenile is asking for damages. In addition to the county commissioners, the claim includes the State of Indiana, including the department of education, the Mooresville School System including the school, the Town of Mooresville and the town's council.
The next scheduled commissioner meeting is Monday, Oct. 3 at 9:30 a.m. at the county administration building.
