SUBJECT A solicitation for a Personal Services Contractor (PSC), Department of State (DOS), Bureau for International Narcotics and Law Enforcement Affairs (INL)

The United States Government (USG), represented by the DOS, seeks applications from US citizens interested in providing PSC services as described in this solicitation.

PRE-AWARD ETHICAL RESPONSIBILITIES OF PSC (JUN 2011) This solicitation may result in the award of one or more personal services contracts as defined in FAR 2.101. Prior to contract award, all offerors or quotes must advise the cognizant Contracting Officer if they have a personal conflict of interest, such as a financial conflict, that would prevent them from either meeting the requirements of the clause entitled, "Post-Award Ethical Responsibilities of Personal Services Contractors," or otherwise objectively performing their contractual duties upon contract award.

HOW TO APPLY Offerors proposal shall be in accordance with the requirements stated in this solicitation at the place and time specified. A proposal will be determined non-responsive and ineligible for consideration unless all required documents and information are included in the submission. Offerors shall ensure their resume demonstrates their possession of the minimum qualifications outlined in this Solicitation, as well as their ability to fulfill all required duties. The Government is not responsible for any costs incurred by the offeror during the solicitation process.

GENERAL STATEMENT OF THE PURPOSE OF THIS CONTRACT AND RESPONSIBILITIES OF THE CONTRACTOR: The Bureau of International Narcotics and Law Enforcement Affairs (INL) is the lead bureau responsible for narcotics control assistance activities and international criminal justice issues for the US Department of State (DOS). The Office of Criminal Justice Assistance and Partnership (CAP) provides technical assistance to INL program offices in addressing the full range of criminal justice development issues in over 70 partner countries around the globe. CAP assists INL in developing strategic partnerships with US state, county, municipal, and federal law enforcement agencies, public defenders and prosecutors' offices, judicial bodies, and correctional institutions to enhance the quality of INL's programs. CAP also conducts pre-deployment training for INL's contracted and partnership advisors before they deploy to their assignments.

Criminal justice assistance is a core component of rule of law development, which is critical to helping countries fight destabilizing crime and corruption and promoting good governance. Currently, INL manages criminal justice policy and programs in numerous countries, employing hundreds of people in the field to implement these programs. The different programs include deployment of American experts in the fields of policing, corrections, and justice to multilateral stabilization and reconstruction missions, including direct secondment of US officers to United Nations missions; bilateral programs to train and build capacity of justice sector institutions, including those programs involving US-based criminal justice professionals, deployment of mentors or other technical advisors, provision of infrastructure and equipment, and working with partners, including grantees, private sector firms and US governmental entities to implement key programs.

The CAP office provides support to these programs, which include international travel, research, training, advising, report production, and outreach to U.S. criminal justice sector practitioners, and the utilization of those partners for INL programs. CAP uses a diverse array of mechanisms to execute its mission, including memoranda of understanding, intergovernmental personnel agreements, invitational travel, and grants.

The Senior Justice Advisor provides guidance and assistance on a full range of legal and judicial reform issues. The Senior Justice Advisor provides technical criminal justice expertise within INL, and on behalf of the bureau, in interagency settings and international settings. S/he will serve as a resource for INL program managers by providing expert guidance in how to assess, design, and monitor justice sector programs (ex: access to justice, prosecutorial reform, defense bar reform and judicial reform) that are consistent with USG foreign policy goals and directives.

DUTIES/ RESPONSIBILITIES * Serve as a senior criminal justice sector expert within INL/CAP and advise on such matters to INL leadership. * Serve as an advisory resource for INL program managers in Washington and in the field on specific aspects of criminal justice reform efforts. Provide analytical services, to include assessments, program design, development of performance monitoring plans, and evaluations. * Conduct assessments and/or reviews of existing programs and procedures and provide draft recommendations for INL programming as a predicate to the development and implementation of initiatives and projects designed to improve the criminal justice system. Write and contribute to assessment reports in a timely manner. * Draft statements of work, reports, program plans, training curricula or other materials as needed to support criminal justice development programming. * Participate as a technical expert in technical review panels related to criminal justice programs. * Attend meetings and conferences and represent INL in the interagency consultative and deliberative processes. * Prepare background and briefing materials, speeches and talking points for a range of Department of State staff including but not limited to the CAP Office Director, INL Deputy Assistant Secretaries and INL Assistant Secretary. * Participate in outreach activities with domestic and international legal communities to increase awareness of INL programs. * Act as a GOR, COR, or AOR in support of CAP criminal justice programs and perform program management and design functions. * Establish direct relationships and frequent liaise with appropriate officers of relevant U.S. Government federal agencies, state and local bar associations, public defender services and district attorney offices, the private sector, and non-governmental organizations in order to coordinate on relevant rule of law programs. TRAININGS & DISTANCE LEARNING COURSES * Completes the Grants Officer Representative distance-learning (DL) courses (PY220, PY222 and PY224) through the Foreign Service Institute (FSI) within 120 days of contract award. * If applicable - Completes the mandatory Foreign Affairs Counter-Threat (FACT) Course (OT610) prior to deployment to Post.

RELATIONSHIP The Senior Justice Advisor will report to the Justice Team Lead within CAP and will be part of a team of justice sector reform experts. The Senior Justice Advisor will be required to participate in weekly INL/CAP staff meetings as well as Justice Team meetings. The PSC will have no supervisory responsibilities. The Senior Justice Advisor will work closely with the other INL Washington HQ staff, US justice sector agencies, Embassy personnel, host government officials, members of civil society, and others.

The Contracting Officer's Representative (COR) is delegated the authority to act for the Contracting Officer in matters concerning technical clarification, inspection and, after concurrence by the Contracting Officer, acceptance of Contractor performance under the contract, including preparation of receiving reports, and the authorization of progress payments when appropriate. The COR will coordinate all work with the Contractor and review Contractor's performance at significant stages of its development.

In no instance, however, shall the COR be authorized to alter or modify the specifications or the contract terms and the conditions or waive the government's requirement, price, delivery, or other terms and conditions. Such changes must be authorized, in writing, to the Contracting Officer.

DELIVERABLES/REPORTS Deliverables are required under this PSC and shall include assessment reports and program recommendations, as well as trip reports and others assigned by the Justice Team Lead. At the conclusion of the period of performance, the PSC will deliver a "Completion of Assignment report."

Per FAR Part 4, the above referenced documents shall be incorporated and copies stored in the PSC's hard or electronic file under Section V.; Tab E - Receiving Reports.

COMPLEXITY The work involves managing and providing technical expertise to a number of different assignments at the same time for various offices and stakeholders. The ability to perform complex analysis and work on multiple projects concurrently is essential.

SCOPE AND EFFECTIVENESS The PSC performs a broad range of tasks related to providing criminal justice sector expertise for the INL bureau. INL programs have a significant impact on US embassy operations overseas.

MINIMUM REQUIREMENTS * U.S. Citizenship, able to obtain/maintain Department of State Secret Clearance. * A law degree from an accredited law school. * Demonstrated seven (7) years of work experience in international criminal justice reform programming, including working in post-conflict or steady state environments managing or directing international rule of law or legal/justice reform programs, international law, and/or the design and implementation of judicial and/or legal capacity building and training programs OR seven (7) years of combined criminal justice practitioner experience and/or international criminal justice reform experience. * Ability to communicate effectively orally and in writing. Proficiency in English grammar, punctuation, usage, and style, and the ability to edit in a form suitable for lay audiences. * Ability to be responsive to multiple requests in a timely and professional manner. * Proficiency in computer and web-based applications including Microsoft Office suite. * Excellent oral English communication skills.

PREFERRED KNOWLEDGE AND SKILLS * Familiarity with State Department policy initiatives. * Three years (3) work experience as a prosecutor, public defender, or judge. * Knowledge of justice sector reform efforts implemented by other relevant U.S. government agencies (e.g., Departments of Justice and Defense, USAID). Knowledge of bilateral and multilateral organizations (e.g. United Nations) engaged in criminal justice reform efforts. * Program management experience. * Subject matter expertise and demonstrated experience in one or more of the following areas (in or related to an international setting): justice sector and court administration strategy and planning; establishment of high-level working relationships with judicial system operators and institutions; planning and managing judicial and legal training and capacity-building programs; guiding participatory reform and transition processes with justice sector institutions. * Experience working in different regions throughout the world. * Foreign language skills, especially Spanish.

EVALUATION FACTORS

Factor 1: Criminal Justice Sector Capabilities (35 Points) Demonstrated ability to provide subject matter expertise on a range of rule of law topics in the justice sector. Experience assessing justice sector capabilities, including the ability to provide policy and programmatic technical guidance within INL, the Department of State, and to a wider audience of interested USG agencies and multilateral partners. Knowledge of ROL practices.

Factor 2: Criminal Justice Sector Development Experience (30 Points) Knowledge and experience of international criminal justice sector development and reform. Experience and ability to substantially assist in developing and implementing plans for improving U.S. capacities to provide criminal justice sector assistance overseas quickly and effectively. Ability to engage with members of relevant USG agencies, domestic legal and judicial agencies, and the international community for the purpose of gathering and disseminating information and developing complementary policies and programs. Knowledge of implementing organizations.

Factor 3: Interpersonal and Communication Skills (25 points) Ability to liaise and conduct outreach with DOS, partner USG agencies, international organizations, US state and local partners, and INL program officers. Ability to communicate effectively, both orally and in writing, in a timely and concise manner; interact effectively with others at all levels to prepare, analyze, explain and defend determinations and requirements with respect to conformance to applicable laws, policies and other regulatory guidelines; and advise program officials. Successful track record of working in a team environment.

Factor 4: Past Performance (10 points) Past performance evaluation of applicant's ability to perform under the contract, especially regarding preferred qualifications. In conducting the evaluation, the U.S. government reserves the right to utilize all evaluation information available at the time of evaluation, whether provided by the applicant or obtained from other sources.

COMPENSATION (BASE PAY) For award, INL will negotiate for this contract based on the market value as outlined above and overall experience relevant to the solicitation requirements.
