BROOKLYN — New York's Appellate Division ordered a new trial on June 5 in a decades-long dispute between Century Indemnity and Brooklyn Union Gas over cleanup costs for three contaminated Gowanus Canal gas plant sites, reports Insurance Business Magazine.
The court overturned parts of a 2022 jury verdict, focusing on whether Brooklyn Union provided timely notice under its 1941–1969 excess liability policies.
The case is expected to be watched by insurance industry players and others with stakes in pollution liability cases.
