New Jersey Lawyers Win $750,000 for Client Injured by Recycling Truck: After a Weeklong Trial, Jury Returns Verdict in Favor of Console & Hollawell’s Client

After a weeklong court battle at the Camden County courthouse, a young South Jersey woman injured by a recycling truck is finally getting compensation. Jurors in the Superior Court case (Docket number CAM-L-4941-10) returned a verdict in favor of the plaintiff on Tuesday, January 14, 2014, awarding her $750,000.

According to court documents, the injuries occurred on December 4, 2008, when the client, Sara Cebollero, was walking back to her Deptford, NJ, home after waiting at the school bus stop with her young daughter. As she passed a recycling truck operated by Republic Services of New Jersey, the truck driver picked up a recycling can with the mechanical arms on the side of the truck, but a trash can became snagged onto the recycling can and it was not secured within the mechanical arms. The second can was propelled over the truck and struck the victim in the neck, causing injuries that ultimately required surgery.

According to court documents, the Defendant, Republic Services, took the position from the very first moment that the snagged can did not strike the Plaintiff, based solely upon its own truck driver’s version of events. According to allegations in the lawsuit, Republic Services made no effort to contact the Plaintiff, despite the Plaintiff filing a report with Republic Services, and despite the Plaintiff visiting an emergency room within an hour of the accident. Then, at trial, Republic Services called upon biomechanical engineers, accident reconstructionists, private investigators and insurance defense doctors to support their position.

“Republic Services attempted to build a case arguing that the Plaintiffs were fabricating events,” said attorney Richard J.
